Warranty help please

Can anyone help with the following, forgive me if in wrong section, didnt know where else to post.

Back in February 2008 I purchased a brand new expensive LOGITECH Laser mouse using buy it now through an eBay I.T seller, paying by Paypal. All was well but now it has gone wrong.

In the past for example with hard drives, I have contacted manufacturer, given serial number etc and they have replaced...no quibbles.

I contacted Logitech regarding the fault, item is suppose to have a 3 year warranty.

The response back was:

Nick, I have consulted to our Replacement Department regarding this issue. After the discussion, I would like to clarify that we are unable to fulfill warranty claims for products which are bought from eBay as our products only carries a non-transferable warranty

Therefore, the bearer of the original purchase receipt will need to contact us in place of the customer, in order to proceed with a warranty claim. You may refer the KB article given below for more information on the warranty replacement issue.

I so far have been unable to contact seller, I cannot pull up the original auction page as eBay only keep records for so long, however I have the Paypal receipt, titled "BN Logitech Revolution Wireless Laser Mouse"

The fault is very common, defected microswitch which Logitech are fully aware of, where do I stand with this? I do not want to be left with an expensive paperweight.

    Your rights are against ebay seller

    You didnt contract with logitech and have no claim against them.

    Did the ebayer advertise the warranty as a selling point?

    If not you have SOGA (if trader) or civil law.

    How much did it cost? whilst you do have legal remedies you might get nowhere easily.

    TBH, You're stuffed.

    You'll either have to pay for a repair or a replacement.

    Ebay comes with certain risks unfortunately...

    No, that is not the case at all. The poster previous to you put it quite succinctly and correctly. The OP will do well to follow that advice, but not yours.

    As stated, I have the paypal receipt which states very little...price, what item is, link to original auction, the link is dead, obviously too old for eBay to keep. The auction page was the part that stated warranty, without that as proof will i have enough for soga

    My post is totally realistic given the circumstances.

    The OP cannot claim via paypal due to expired time limits. The Ebay listing has expired and there are no details. Therefore, little to no recourse via the Ebay/Paypal services.

    The OP has already said they cannot get in touch with the seller, if this remains the case they have no rights to a warranty.

    Unless they can get in touch with the seller (unlikely) and get the original receipt ( Highly highly unlikely ) then they're stuffed.

    To suggest taking down the civil law route over a £30/40 mouse is quite frankly ridiculous. Getting the OPs hopes up when the circumstances suggest they've got little to no chance helps no-one and just wastes their time.

    Sorry, but you really need to ensure your posts are realistic!

    You seem to have conveniently ignored a certain point by the previous poster to me who happened to also mention

  • it maybe a £40 mouse, but yes, out of principle I would consider the civil route.
    I have since contacted eBay, explained situ and requested contact information for the seller. Failing that, I have his real name and know the area he lives, name is unusual, so getting the info should not prove too tricky.

    As you cant identify the seller SOGA is irrelevant. If you can identify the seller it needs be a proper trader not some individual with a few items to sell.

    Did you register the product with logitech after buying it? Normally products with long warranties ask you to do this, and they usually state that they need to be bought from a reputable (i.e. genuine) seller.

    why not just contact logitech again? Unless they've been making the mouse for over three years, you can prove you purchased it (from say PC WORLD) or similar and have misplaced your receipt during that time, due to moving house, travelling the world, joining a circus, being rescued by a talking mouse, and re-uniting with your mum etc etc.

    I wouldn't buy anything from them again based on this service. The grammar is poor in their response too.
