Yes don't worry, I stopped paying all my creditors (inc mortgage) in January of this year and didn't go bankrupt till the end of April. They'll just say anything to get you to pay

Don't worry I fell into the trap of not paying my creditors for 2 years! They have recently caught up with me and now it is time for me to get my head out of the sand. I was advised that with me not paying them hasn't made the situation any worse (financially) and I haven't looked to get credit anywhere else. The credit companies can say what they like, I was also told to be prepared for some lies and scrare tactics. Good luck with your BR! I am going to court on Thursday.0 -

my friend has just made the decision to go BR..I should know the answer to this question really as Ive went BR myself this year.
does the fact that she has stopped paying ALL debtors for the last 18months affect the ORs decision on her BR. She has kept her rent/c/tax gas/elec etc up to date and her car payments (preferential treatment??? to this partic debtor)??
I suspect that she has taken some more credit out whilst not paying the other debts ie her new TV:rolleyes: :rolleyes: :rolleyes: will this look bad when she has her OR interview, Ive kind of done a draft BR form for her it makes horrible reading:eek: she will certainly get a IPA and most likley a BRO could she plead insanity lol..what Im really asking is if youve ignored your situation and just plodded on ignoring your debtors letters calls etc can the situation get any worse for her..I finally got through to her that she cant go on living like she has..her kids will suffer and now her ex husband has been made redundant her maintenance payments are zero from Feb 2009 so its face reality time, painful I know but I think she would sleep better at night.
She has no assetts to protect except her car and most of the debts are credit cards and debtors are HBOS/Citi Financial/HFC/Barclaycard/Hitachi Capital /GE Capital and now some of them have sold on the debts to DCA`s who are now like wolves sniping at the door/phone calls etc infact the whole worst debt scenario is happening .
I know this can be sorted, she will havea lean time of it but the knowledge of being debt free but skint seems to have hit home.
Ive persuaded her to post on here, but at the back of my mind is the question if you have willy nilly built up these debts and not paid them and took on more debt whilst in debt would BR be refused???

BR would not be refused, but if she has "incurred credit with no reasonable prospect of repayment", i.e. taken things out on new credit when not paying back the other creditors, it could lead to a BRO.0 -

thought so...BRO well thats nothing in the wider picture of peace and tranquility and being able to sleep at night.
shes asked us all to give her a very small cash chrissy present towards her BR fees..probably the first time n her life shes thought through something and will see it through to the end
FERGUSOR sorry for hi jacking your post...I hope things work out for you...BR was my salvation, light at the end of the tunnel, the realisation of that peice of paper with the court stamp on made my day my month year life and lifes sweeter if not skint I love each day now and money means nothing I have my sanity back best wishes for the future..
