A friend of mine has just found out that her card has been cloned. She had used a cash machine in leicester and has had £450 removed from her bank account. Does anyone know who is liable for this money. Has she lost this money or can she claim it back from the bank.

As long as she wasn't negligent, reported the problem as soon as she spotted it, and the bank believes that it wasn't her that made the withdrawl then she should get the money back ok.
EDIT: Just to back that up here is an extract from a Guardian article about the recent cloning on the Tube ATMs:Banks have to return the cash to customers unless they can prove the individual has been negligent... Banks do not return the money until after they have carried out a fraud investigation, which can take six weeks.0 -

I once had £100 taken out of a cash machine in my home town when I was far away on holiday. The bank (Nat West) insisted long and hard that it must have been me or else someone else in my family and I had a long and unhappy fight with them over it. Fortunately I noticed that the transaction was at a very similar time to when I was using the card at another branch of the bank in my holiday town and could therefor prove that I had the card with me and could not have used it when and where they said I did. I think it depends a bit on how good your bank customer service is and also times have changed a bit as they do now accept that peoples cards can be cloned. Do let us know how you get on. Needless to say I've never banked with Nat West since, and I was only with them for Air Miles in the first place, which I never did collect. Good luck0

You should not worry if the card has been used illegally. The bank will reimburse providing there is no act of negligence in the handling of the card or its details.0 -
Banks in several countries in the Middle East have all their ATMs covered by CCTV. This achieves two things, one, it deters ATM Fraud and two it helps resolve disputed transactions (The Banks own words).
With the roll-out of Chip & PIN, PINs will become the weakest link in the scenario. I predict it wont be too long before disputed transactions are being question which are carried out in that time between losing your card and reporting it lost.
Prior to Chip & PIN, PINs were used primarily with Debit Cards - having a PIN with your Credit Card is a whole new ball game.
Opt for Chip & Signature you know it makes sense.
The BBC yesterday - Banks misleading (blind) customers over new cards. I'd leave out the blind unless it's a legal requirement to have to accept a PIN with a Credit Card!
