Selling a joint ownership property...with issues...

    As ever, it's down to negotiation/agreement between the parties. If it couldn't be agreed and one side wanted to pursue the matter, it would be for the Courts and - of course - they would decide what seemed fair, based on the circumstances.

    It could be argued either way and - as each party has a joint financial interest - they should be able to reach a mutual agreement. But, sadly, in relationship breakdowns "mutual", "agreement" and "joint" rarely describe the discussions that ensue, especially over money!

    (Not sure if it should be sellable or saleable.)

    Ah, the wonders of the English language, eh? ;) Although I have been a stickler for "grammatical correctness" most of my life, I have recently been persuaded by the argument that language evolves and grows/changes over time. Otherwise, we'd all still be speaking (and spelling!) Elizabethan English :rotfl:

    So ... I could live with either, as I knew what you meant :D

    Thanks for the replies. It is my intention to sell as fast as possible. I wanted to sell for the offer we had...It would have been taking £3k negative equity but then this would have been over. My ex is being a touch inflexible about the price she wants. She is refusing to sell for less than £141k. An unrealstic price in the current situation!

    We were not married but did have an agreement drawn up with solicitors that in this situation, the house would be sold and it was 50/50. I have even offered to just transfer the sole ownership of the property to her for absolutely nothing...She is refusing that too. I just feel like I'm totally trapped in this situation and about to be screwed over by her. I think if it does continue down this path and she continues with this behaviour then I will move out.

    As it stands I have agreed verbally to port our fixed rate mortgage across to my name when it sells to avoid the £4k penalty charge and to transfer the secured loan to my new property. I really don't know what else I can do other than wait for a sale.

    Where would I stand on renting out my room to someone? Do I need her consent to do that?
