of course this is discrimination, but would you want to work for such narrow-minded and biased company?
I smoke and I have had 3 sick days this year, my colleague who doesn't smoke was off for a month in Feb and off an additional 6 occasions after this.
If you were gay, black, blind, deaf, disabled or 20 stone overweight, you could take this company to the cleaners for discrimination, but smokers are treated like lepers

Smoking is a lifestyle choice.
It is not illegal to choose not to employ someone because they smoke.
I have personally chosen not to employ a smoker several times in the past, when interviewing and selecting office staff for my employer. It is my right to do so (and my employer knows I have done this, before you say!).
I also think that smokers should clock out when they go on their far-too-regular cigarette breaks. We worked out that the typical smoker in one of our offices works between 5 and 6 hours per week LESS than a non-smoker.
There is no Smokers Discrimination Act and, thankfully, there never will be.
To the OP. If you want the job, stop smoking. It's Moneysaving too.
In my last job, working for a City Council, we non-smokers put forward a suggestion that we should have Friday afternoons off as we worked more hours than the smokers. It fell on deaf ears.
The smokers were allowed a break morning and afternoon to smoke, non-smokers didn't have this.
So I think WE were discriminated against.(AKA HRH_MUngo)

afraid not. I'm overweight and know I definitely didn't get 1 job a few years back because I didn't look the part. Working in PR is a very image conscious industry, the job was based in Mayfair and was at a senior management level.
I am not a smoker, my OH is and I have to say, you can smell smoke on him all the time, whether it is 2 minutes or 2 hours since he had one.
It's discrimination, but not illegal.

Of course you can smell fags on any smoker.
I can even smell them on the paperback books I have borrowed from my smoker friend.(AKA HRH_MUngo)

Well at one company I used to work, the smokers used to spend an ADDITIONAL 20 mins each morning and afternoon having a cig break. This was on top of their breaks and lunch hour. If you add these 40 mins a day, over a year - that added up to just under a month's amount of hours. This obviously annoyed me and other non-smokers. As they got a month's pay for smoking! That all changed and only allowed to smoke before work, during breaks and that's it. If anyone smoked outside their breaks - it was displinary action!

we all have our bad habits/vices
and you might not see it as a problem to others but even something tedious like leaving the toilet seat up or leaving pubic hairs in the bath or on the soap can be very annoying to others, in fact I find this more offensive than a lot of thingsTime is the best teacherShame it kills all the students
