Gym Membership Cancellation

Hello,

I wrote to my gym at the end of October giving them a months notice to cancel my contract (which has been over 12 months so no problems there). I cancelled the DD with my bank and thought nothing more of it. However, at the weekend i received a letter from Leisure Finance saying they couldn't take payment and when i contacted the gym, they said they had never received my letter, therefore i still owe money (+ charges) for my missed DD on 1st December. Do i have any rights as I don't have proof of postage or will i just have to pay up for the next month knowing i'm not going to use it and learn my lesson for next time!

Hopefully somebody can offer me some advice!!

    I would be suprised if they hadn't received it. Do you have a copy of the letter on your pc?

    Send a copy (recorded delivery) ASAP. I would hold off from paying them, and see how many other people have similar stories to this?

    Gyms have an AMAZING ability to lose cancellation letters. In fact, reading these boards, I've never known so much post to go "missing".

    It's always best to deliver it by hand, or send recorded delivery.

    Personally, I'd take the previous letter in person, and tell them that you DID send them a letter, so if they're going to charge you for another month, they should at least let you use the gym for another month.

    Good old rolling contracts.

    I would write to them enclosing a copy of your previous letter recorded delivery explaining the situation and disputing their charges.

    Give them 10 days to respond after which you will consider the matter closed

  • Thanks for the responses guys, I still have a copy so I'll re-send recorded delivery and see if that gets me anywhere. (and i'll learn this lesson for next time too!)

    I spoke to the gym again after posting and they said that the company who take the Direct Debit charge the gym so they would have to charge me otherwise they are losing out.

    I'll update you when/if i get this resolved. At least this has got my heartrate up, which is the idea of gyms i suppose!!! Grrr!

    gym memberships are shocking for cancelling. I mean there must be a huge Royal Mail bag dumped somewhere full of all the "missing" letters!

    can't have them losing out can we?

    maybe they should look at their administrative processes to avoid situations like this occuring again.
