TalkTalk sent cheque in maiden name

I have my landline with TalkTalk and haven't yet changed the account name to my married name  not been married long, anyway they have sent me a cheque today in my maiden name but my bank account is in my married name, can I still deposit it does anyone know? I must get the name changed, just a pain they won't do it over the phone and I have to traipse to a Carphone Warehouse with my marriage certificate.

If the account was originally in your name .... you can try it. But if it's a new account they won't accept the cheque ..... if they notice the name over the counter.

  • Maybe take the cheque in, try paying it in, and if they challenge it have a copy of your marriage certificate ready to show them?
  • What billbennett said. Bring your marriage certificate, they should be OK with trying it for you.
  • Unfortunately they said no :( Thankfully Carphone sorted it for me though and I should get a new cheque in 7-10 days!

If it's within the past month they should be able to pay it in anyway.

Taking your marriage certificate will do nothing. Cheques are all sent off by the bank at the end of the day to go through central clearing. They can't send a copy of your marriage certificate with the cheque, so the name on the cheque MUST match the name on the account.

But that's only at the point of deposit (assuming your paying it into your own Bank).

Once the cheque is past that point it's immaterial. The drawer isn't going to object ..... as the payee was inserted by them and they don't know if the credit is being claimed from a maiden name or a married name account. They leave the payee Bank to do a basic cockpit check that the cheque is going into the correct account.

I had this problem for a while after I'd changed my name. My bank accepted cheques in my old name for about two years, though I did go along and pay them in personally and explain each time. They just checked the records and said okay.

I did try a while after this but they refused (It was about 4 years on) so there must be a time limit.

It boils down to reasonable discretion by the bank.

The key is that they have to protect the interests of the payee.

If they can establish that the payee is the same person as the individual depositing the cheque (eg marriage certificate is rather convincing to me) then they should let it through as there is no risk of loss.

I think the OP should name and shame the bank for this inappropriate lack of discretion.
  • I have recently received a letter saying I'm due a refund from a credit card acount I closed about 8 years ago, so I rang to claim and gave all my new details as letter was sent to previous address and in my maiden name. I have now received a cheque for my refund, however cheque is still in my maiden name depite me making them aware of new name. I have rang again to make them aware, but have now been told they're unable to change my name and issue a new cheque because my account is closed. I bank with RBS, and Ulster is part of the same bank, so if I go into my RBS branch and explain will I be able to pay my cheque in? My bank account is in my married name. . . .

If you cannot pay into the account in your married name you might be able to open an account in your maiden name ad pay the cheque into that. A lot of people use both names these days for different purposes e.g. married name for personal stuff and birth name for professional, work, qualifications etc
