iphone mute switch problem

I bought a used iphone but noticed the mute button seems to be stuck on . it slides backwards and forwards but dosent come off mute , ie the phone does not ring , the speaker works ok , I have tried repeatedly inserting the headphone jack incase it was that stuck but it dosent seem to be , ring is turned on and not vibrate but still no ring , it the switch a button over hte switch on the motherboard? as I wondered if it had come off the top of the switch so it wasnt actually switching mute on or off? Its not a major problem as I only use it for the net but would be nice to get it sorted , the case looks easy to take apart on youtube so thought I might have a go.

Check your sound volumes in settings>sounds
Also check to see if an icon comes on your screen when you flick the mute button either with a bell or a bell with a line through meaning it must be doing something.
If that fails, try a restore...if that fails...repair0 -

Are you sure it's not still under warranty?
According to a Google search, even if it's the 1st generation it only launched Nov 2007. Even if they bought it the first day it came out, it can't be more than 12.5months old.
I'm pretty sure they have 18 month warranties on-contract, but that probably doesn't transfer if you bought it second hand. That said, I'd query the problem with whoever you bought it from.
Silly question - but have you tried a reboot?0
