Halifax Overdraft Expired Without Notice
Comments
-
A review date is not notice of withdrawl, it is a review date, and that cannot be ignored.
It may not be notice of withdrawal but it is still notice that account lending will be reviewed and as a direct result (as mentioned before) the overdraft being removed is one of the things that can happen.
I've checked the terms and conditions (seeing as I also have a HBOS account) and copied what is relevant to yourself. It does indicate that if changes are to be made on the overdraft at the review they will send you a letter. However this is not stated in condition 27.3, which, if you read, is a list of other reasons for changing your overdraft.
"If we agree to an Arranged Overdraft, we will decide your overdraft limit and tell you what it is. We will also tell you when we will review it. At that time we will review your Arranged Overdraft and decide whether or not to continue to provide it at the same limit, and inform you of our decision by letter. We may also change your Arranged Overdraft if condition 27.3 applies.
27.3 We may change your overdraft limit at any time but we will usually only reduce your overdraft limit or withdraw your Arranged Overdraft where:
• You have failed to fund your account regularly;
• You are in breach of a condition relating to use of the overdraft;
• Your circumstances have changed for the worse;
• We reasonably believe that the risks of lending to you have increased; or
• We reasonably believe that the reduction or withdrawal of the overdraft facility is necessary to prevent you from incurring a debt which you will be unable to repay."
Personally I don't think you have a leg to stand on complaints wise, unless you can prove (beyond a reasonable doubt) the overdraft was not removed due to one of the things listed in condition 27.3. Like I've mentioned in the previous post going through the long drawn out complaints procedure I think is a fruitless endeavor but it may bring the matter to close. I hope the terms and conditions help, you can find full copies on the Halifax website.Anything I post is my opinion, so from time to time I may be wrong. I try to provide answers based in fact, however I don't know everything, so (like all posters on MSE), take what I say with a pinch of salt.0
