Do they have to honour the deal?

I've got a problem with an Amazon seller and I don't know if I am right or not.

I bought two battery chargers that come with a set of batteries. The product page had a whole bunch of sellers but one seller was showing the charger at two prices; one at £5.65 and one at £8.99 (the other sellers were all above £8.99). Obv I ordered two of the £5.65 proced ones.

When my delivery arrived i opened it up and found two packs of rechargeable batteries only - no chargers and the delivery note only mentions batteries.

I contacted the seller and they told me that the listing was a mistake and one (the £5.65) was showing against the wrong Amazon code and should have been for batteries only and the real charger price is the £8.99 one. They've said they can't sell the chargers at that £5.65 (they've corrected the Amazon page) and have offered to pay for the batteries to be returned to them and to give me a full refund.

They were very apologetic and sound genuine - they have good feedback so I don't think it is a scam but am I allowed to stamp my feet and demand they send me the chargers at the price I paid?

Any opinions?

  • They have done the decent thing by offering the refund plus postage.

    You could insist on the deal being honoured, but, imho, I would suggest that it would be reasonable to assume the price is wrong when compared to the others. Even so, I doubt the time and expense pursuing this would be worth the money involved.

    I think you would be best off accepting the return and refund.

    Hmmmm, difficult one. If you were in a store and saw a mis-price like this, they can either sell you the item at the advertised rate or withdraw from sale.

    The fact they have sent you an item (albeit the wrong one...) - now, does that mean they have agreed to the sale? I wonder....

    Anyone with super-sized brains full of consumer rights?

    Just occurs to me, from working in House of Fraser many years back, the old 'well it's advertised at that price' 'well then we'll take it off sale' argument doesn't really work in online purchasing, surely?

  • If they withdrew the offer within an hour or so of you querying it then it was a mistake. I'd say get your refund and provide them some positive feedback for resolving a problem quickly but i am a big softie.

    It's unfashionable to say this here but it's only a few quid.

    It sounds to me like a genuine mistake, and so long as you're not out of pocket, then perhaps best to just let it go, and pay the actual price.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • Thank you all for your replies and advice - I feel I was due something but it was strangely cheaper than the others so I guess it was a genuine mistake and as suggested it isn't really worth the effort so I've let it go.
