Advice please

Hi
I need to get some advice for my fiance. I have successfully become bankrupt (thank you to all the people that gave me advice - it really helped alot :beer: ), however, my partner could really do with also becoming bankrupt.
He has no way of paying the bankruptcy fee of £495 outright and he would have to save for this. The problem he has is that he is currently with a debt managment plan (Gregory Pennington) and they are asking for £65 a week towards paying his creditors - he can't pay any less than that as he has missed so many payments due to being unemployed. He does have a job now but this is a very low paid job that only just covers the bills.
Can he stop paying the debt management plan and say that he wants to go bankrupt?
How would that impact on his payment to creditors in the time taken to save for the BR fee? i.e any really bad things that might happen?
If he saved the £65 each week it would take him about 2 months to save the £495 BR fee.

Has he taken advice from one of the debt charities listed in the sticky at the top of this forum?
It is fine for him to stop paying the DMP and save for BR. Nothing too harsh will happen, just lots of threatening letters and maybe some phonecalls (just hang up). He shouldn't tell them he plans to go BR, just stop paying and ignore them untill he has the cash to do the deed.
If he is going to do it he MUST save his socks off and get that fee together ASAP. It would be too easy to stop paying the DMP and enjoy some of the cash. That cannot happen.
I paid a DMP through Gregory Pennington for 2 years before I went BR - they just added to my already desperate situation - most of the £65 your fiance is paying will be their fees!!!
I must stress that he will need to get professional advice from a debt charity - the BR judge will expect it.

I am with GP too on a DMP, I pay them £60 in fees. Since reading post on this site I have found out that there are company's that dont charge a fee. I am gutted about that.
I called CCCS an have a telephone interview on the 16th Dec. I think I was wrongly advidsed to go go with GP and take DMP. now I am waiting to confirm that I need to go BR.

It should be clearly advertised by the government that -
ANY COMPANY THAT CHARGES YOU A FEE TO ORGANISE/MANAGE YOUR DEBTS IS NOT WORKING IN YOUR INTEREST!!

If you don't want to stop your DMP or want to go Bankrupt earlier. You could see if your current or a former employer has a Benevolent Fund to help with your Br fees.
Also you could try your energy provider if they have a charitable trust. Union?
If you are a low earner you maybe able to get help with the court fee (£160) BUT you will still have to pay your Br deposit.0 -
I totally know what you mean with GP and their fees. I was with GP before going BR myself - I had been with GP since 2005 and when I looked back over thier statements when I was putting my SOA together I noticed that each time my annual pay went up and they requested more money, they would only add a few pennies towards payment of creditors and give themselves about a £10-£15 rise in their own management fees! :mad:
Also, when I did have the money together finally for the BR and told GP I was leaving them, they did all they could to try and stop me. I have to say that I didn't believe a thing they said about how BR can affect someone as, at the end of the day, I think they would have been more bothered about loosing their fees!
They really hound my fiance when he has missed payments before and they threatened that if he missed one more payment that the plan would be cancelled.
I defo agree that he should call someone like CCCS and perhaps start to save for the BR fee in the mean time...

They only `hound` him as they won`t be getting their fees this month!! Remember they are not allowed to threaten or harrass.
If their behaviour feels like harrassment then get the persons name & complain....I did with MBNA & they stopped calling me for a while.0 -

Thanks So Sad Angel - you're right there - I think that:
1 - he needs to contact CCCS for advice and,
2 - stop paying DMP and save frantically for BR fee!

Hi ya,
I was with GP a couple of years ago. I wouldn't reccommend them to anyone as they don't care about you. We were evicted (from private rent) for rent arrears and was told by the council that as we'd been paying the dmp we had intentionally made ourselves homeless. Although on the advice of the CAB I'd tried to cancel the dmp they kept insisting that i'd be debt free in five years, despite telling them I was being evicted. I actually said that to be debt free will be great but I won't have a roof over my head. They said, you'll sort something out. I did, I told them I wanted to cancel and that I had already redirected my wages whether they liked it or not.
I never heard a thing from them after.
Just tell your Fiance to be strong with them on the phone, and to ignore all their cr*p. I then went on to make my own payment arrangements with my creditors - which due to the dmp I found that they were ok about reducing payments. (Since them it's all gone t*ts up so we're waiting to go br).
