SORN and prisonment

Hi, friend's son had written his car off few years ago. It is parked on private land and he is selling parts off. Every year he sends in a SORN to declare it off road. Unfortunately he was with a mate who attacked someone. He was named as one of the attackers. He has been in prison until the case starts. Anyway the date for the SORN renewal came and past. His mother just received a letter from DVLA asking for £40 fine and overdue duty. Naturally him being inside SORN was the last thing he will be worried about.

What can my friend do regarding the fine etc. If she explains he is inside will they waiver the fine?
Problem with having access to internet is that i get asked by many to solve their problems :( Well at least i learn something on the way :D

    she plans to ring them tomorrow. was hoping to have any advice etc ready beforehand.

    Don't use the 0870 number, use one of these:

    update - friend rang up dvla, the person was helpful and instructed her to write a letter detailing the circumstances and her son's prison address and number. They will review it and it seems that they might waiver the charges. They will let her know in a few days after receipt of letter
