Claim against Natwest...

Hi. Sorry to hijack the thread but the main Nat West discussion has been locked for some reason.
I've asked for DPA statements for two accounts held with Nat West (one now closed). They've sent me the info for one of the accounts and it's got the "Manual Intervention" letter at the front. I assume it's just their way of saying "If you continue with this we will close your account" kind of this but are they actually likely to do that? Am I better trying to get another account somewhere else in the meanwhile?
Thanks.0 -
I think what they are saying re manual intervention is fairly standard to be honest. I do think you might want to remind them re the second account as well.Hi. Sorry to hijack the thread but the main Nat West discussion has been locked for some reason.

They don't have to unless you are in financial hardship. If you do have arrears then post again cos I have a better address if you need it.I wish you lots of luck with the Natwest.
They have done exactly the same to me - i.e. unpaid dd, re-requested so another charge. £266.00 in charges in the last two months.
Both their Manchester customer service and London customer relations were completely unhelpful and refused to refund anything at all.

Okay, I've just recieved the standard fob off letter from Natwest which outlines the fact that the OFT case is ongoing - yadayada... as i'm not in financial hardship (but would quite like some if not all of the money they took from me) do i need to proceed with a courtcase (which will automatically be stayed to draw the line in the sand or do i simply sit and wait at this juncture?
Cheers again for all the help

The bank have acknowledged your claim so unless you want to spend time and money filing at court, you can wait for the outcome of the OFT test case(your decision really).Okay, I've just recieved the standard fob off letter from Natwest which outlines the fact that the OFT case is ongoing - yadayada... as i'm not in financial hardship (but would quite like some if not all of the money they took from me) do i need to proceed with a courtcase (which will automatically be stayed to draw the line in the sand or do i simply sit and wait at this juncture?

thanks - if theres no discernable advantage to doing the court thing now then it can wait - if on the otherhand it'd move things forward then i don't mind the expense or hassle

i assume any filing i do now would be automatically stayed till the point when the OFT case is finished anyway?
cheers

Hi all. An update and request for help.
In the light of the court ruling i recieved a reply from natwest about my case in January saying they were closing the case due to the ruling. I replied ithin the 8 weeks they set as a deadline for appealing this closure with a custom letter explaining my case.
The letter contained a number of arguements from the sample letters referring to the punative nature of the fees specifically in relation to the "snowball effect" that they had on my account during a particulary bad spell instead of the original case which was built on the "unfairness" of the level of charges. My arguement being that the bank should have dealt more fairly with me as a person in difficulty rather than punatively charging me fee upon fee which then caused a futher cascade of fees.
The letter had a personal feel rather than a templated one which i felt stated the case stronger.
Natwest replied this morning with a standard template letter saying that "if you're in financial difficulty you need to fill in this two page document and send it back to us". Is this a standard "fob off" tactic? I'm not in financial difficulty anymore as i resolved the problems i was having and broke out of the spiral of charges by putting my head down, working every hour under the sun and making every penny count. The scale of charges is such that its under the small claims limit at circa £3500.
What should i do next? I dont believe that filling in their hardship form to be a worthwhile exercise as i'm able to pay the bills and certainly am not behind with any of them. The hardship I experienced relates to is a past period of time and my letter specifically states this to be my case.
Should I reply returning the hardship form and giving them 14 days to read my letter properly and act on the contents rather than sending irrelevent documentation by default? following this with a threat of FOS or county court action? Or should i make a different appraoch?
any help much appreciated.

If you are arguing punitive nature of the charges under common law then the argument is a dead duck cos that argument is gone forever imho.
I would re read Martin's guide. Did you ever file a claim at County Court against NatWest because that claim is still live in the system if you have done?0
