Hi,
I have a very good friend that is in serious money trouble. He is struggling to pay his creditors and is considering bankruptcy.
However, the main thing that is causing him a lot of grief is Barclaycard. They seem to have his current account debit card details and even though he called them and made a payment which was under his minimum but all he could afford, they have not only taken that payment but they have also taken the minimum payment too. They have done this for 3 months in a row now and his bank charges caused by it are around £120 a month now.
My question is, is Barclaycard allowed to remove money from his account by using his saved card details without permission ? and if not, who does he moan at Barclaycard or Natwest (his current account owner) ? and what chance does he stand of getting any money back seeing as he does owe Barclaycard the money ?
Any help is appreciated.

Barclaycard probably have some continuous payment authority if your friend is failing to meet minimum payments. Or they could just be trying their luck.
Suggest he reports his debit card lost to NatWest and gets a new one with a new number - that should give him control back from barclaycard.
Next thing is to get himself to citizens advice or speak to the CCCS about his debt situation and what his options are.
Much will depend on his assets, income versus debt etc, but they will be able to advise the best action.
