    I would have thought they (your current employer) couldn't put anything about the suspension & investigation in a reference because its still ongoing and nothing has been settled yet??

    Have the new job asked you for references yet? Could you give them the name of a previous employer or character reference instead/ aswell??
    With regard to your letter I would try to be diplomatic/ professional (difficult i know given the way you've been treated) but state clearly and politely your reasons for leaving!

    Well thats the path I would choose anyway!!

  • I would not even consider writing a resignation letter yet as that may mean that, even though you would still be employed by them for the next month, they would not bother concluding the investigation an disclipinary meetings. You would never be able to say you have cleared your name.

    In your position I would just carry on as normal as surely the ball has started rolling and it will be decided upon within the next month. I would sooner either leave after they have failed to prove the allegations to be correct or at least get the opportunity to threaten them with an Employment Tribunal if they think they have a good case against me. They might then offer you a financial settlement which you deserve for the stress they have put you through.

    What about telling them you have been severely stressed by this matter and you feel they want you to leave? You could offer to leave if they give you a redundancy settlement and a reference which doesn't refer to this matter and an agreement from you that you won't go around slagging them off.

    They have treated you badly so, although I wouldn't normally advocate a 'tit for tat' mentality, I would not treat them with respect my tendering my notice. If I bothered at all I would tell them on the day you leave that you are leaving just before you start your new job (as long as it is after receiving this month's pay).

    Congratulations on your new role RubyRue. A couple of suggestions I would offer are to make an exact log of the evidence that they have sent you and email them to say that this is what you have received and that you trust will be the only evidence that they refer to during the hearing. That way they can't suddenly produce evidence that they have witheld from you and use an excuse of it getting "lost in the post".

    With regard to your exit strategy. Timing isn't ideal it would seem with your new employers expecting an answer and your hearing not until 2nd March. I would definitely say that you don't want to mess your new employer around. I assume you are going to have to provide a reference which again may prove awkward. I am generally of the opinion that honesty is by far the best policy and it may prove prudent to request a meeting with your new manager or even their HR to explain your current situation in a very open and frank manner of not wanting to have any skeletons in the closet.

    With those skeletons out of the closet I would then inform your old/current employer of your departure under sufference and an intention of filing for tribunal for constructive dismissal.

    Hi All

    Just thought I'd give another update. I had my hearing yesterday... and I still have a job, it was the most horrible experience I've ever been through but at least its over now.

    My potential new employer has sent out for references so I'm waiting for a confirmed start date before I hand in my notice. Can't say I'm really looking forward to going back after all the stress etc but hopefully it won't be for too long and in this climate its definitely better than standing in line at the job centre. My plan is just to keep my head down and get on with it and make sure I get everything in writing!!!!!

    Thank you everyone for all your helpful advice and support, its been a life saver!! I wouldn't have had a clue how to get through all this without it!!!

    Hi Rubyrue. Great news that you still have old job and can now make a dignified exit. Did they back down and admit fault or did they try the old, "We'll let you off but don't let it happen again........." trick? Move to your new job, excel in it so that you can then rely on them for a reference and then sue old employer for constructive dismissal as you no longer need to be loyal.

    Great news ruby rue, dont forgot to make sure you have taken all your holiday entitlement before you leave!
    When I left my previous job I still had two weeks of holiday pay left and so had that time off during my notice period so that i didnt miss out, plus I got to start my new job earlier than expected!!
