    why don't you take someone else to come in and take notes, and act as an independent witness? then agree what was said at the end of the meeting.

    State you cannot sign as you do not agree (is it something along the lines of agreeing with the minutes as an accurate representation of events?)

    are you looking for another job? this may not be practical advice, but if it's a job you're not keen on, could you not find another while this drags out?

    Thanks for all the advice, yes I'm on the job hunt as I'm relocating soon and need a job closer to where I'm going to be living.

    Yes they are asking me to sign it as a true and accurate respentation of the meeting which it clearly isn't and I've pointed out the parts that they have changed but it they aren't willing to change the original transcript so after all the advice then I won't sign it and explain the reasons why I'm not signing it.

    Well done RubyRue, Never sign something if you don't feel comfortable signing it. To me it sounds like they are just looking for an excuse to get you out the door. Stick at them, don't let them get away with this because they may do it to another member of staff.

    Also, dont let them wear you down. I know it can be easy when a whole company is against you but stick at it. The truth will show itself eventually and all those in the wrong will hopefully be shown for who they really are.

    As an HR professional I thought I'd give you my advice.

    Don't sign the minutes as a true copy if they are not. You don't need to as they have already told you that they will include your copy with the appendices. Simply reply politely to the email advising that you are not signing as they are not a true copy and you understand that they will include both copies in the appendices.

    If they intend to call you to a disciplinary hearing you will receive notification in writing. That notification MUST set out the specific allegations which you will be required to respond to. And I mean they must be specific ie dates and times etc.

    When they send you the letter calling you to a disciplinary hearing they must proivde you with copies of ALL the evidence that will be included at the hearing. Depending on the amount of evidence, you may wish to ask for a postponement and they should allow that on one occasion. If you think there is some evidence missing which would support you case, then you can ask for it to be obtained ie a statement from your line manager, print outs of in/out times etc.

    I would not tape the meeting but would take someone with me to take notes of the meeting. Depending on the length of the meeting, you could ask for the hand written notes to be read back and both parties agree and sign them.

  • I went through a disciplinary years ago where it was my word againt someone elses (I was telling the truth!). I'm sure they were trying to get rid of me, but couldn't as there was no "evidence" of who said what. However about 2 weeks later I was made redundant. Not long after someone else was doing what i use to do, so the job was not redundant at all.

    Obviously at the time I was heart broken as I'd always worked hard for the company, but new people wanted to mark their territory so I had to go. However, I got money to install my central heating and I got out of working for a "nasty" company and went to work straight away for their rival.

    So don't be suprised if after all this they bin you anyway, but it could be the best thing to happen.

    I imagine the stress if quite awful - hopefully it will all be over soon.

    Hi Again

    I followed your advice and wrote back to my employer stating that I wouldn't be signing the transcript on the basis that it was inaccurate and incomplete and I also askied them to clarify the Hearing they mentioned, ie what was its purpose and when it is scheduled and they have responded with a two liner saying they would still appreciate it if I sign the document and that HR would be in touch shortly to inform me of the next stage, I'm yet to be informed that the investigation is complete or what the outcome is so still don't know what this Hearing is.

    I'm not really sure what to do next or how to respond, I don't know how I can make it any clearer that I won't be signing the document.

    Just don't sign it Ruby.
    Goto the CAB and get some advice. This seems to be dragging on aswell. usually these things are sorted one way or the other pretty quickly.

    I think you have done the right thing.
    You may consider replying asking what time scale "shortly" implies and that you have noted their request for your signature but, for the reasons you have already outlined, you will not be signing.

    I would give ACAS a ring and see if they can set your mind at ease and provide some guidance
  • Join the union as soon as possible and take someone with you into the meeting.It does seem to me that they are looking for an easy way to get rid of you.If you did claim to be in the workplace and you were not and they prove it eventually then it is classed as fraud.Any future employer will ask for a reference from the employer now so be aware of this.
