Enduring power of attorney - What can be given on her behalf?

My husband has power of attorney over his mother’s affairs. She is ill in hospital and his brother and sisters are finding it difficult to make frequent visits to see her. this is partly due to the travel costs as they live some distance away.

We know that his mother likes to receive visitors and she especially likes to see her family, and when she was well she used to help out with a few quid towards petrol or train fares.

We understand that under the EPA rules he is able to make seasonal gifts but we are not sure as to whether he’s allowed to help them out from her funds with travel costs so that they can visit her more frequently.

    Sorry I can't really help you on this.

    But, in my opinion, I would suggest that it would be reasonable to allow her money to be spent in this way, as for one it is to benefit her, and secondly, it is continuing her established spending pattern.

    Hope you can get some help on this,

  • Thanks for your reply. I tried to contact the Public Guardianship office for their advice, but couldn’t get through; is it worth trying to phone them again? Are they likely to be helpful?
    Any other thoughts would be most appreciated.
