Xbox game very scratched - request refund?

I have had many discs arrive loose, and never had one so much as scratched.

I spoke to my husband and he said that the game should word fine even if it has scratches ..
that also made me wonder if they knew of the marks

If you can't get your money back, then your best option is to take it to a GameStation or GameXchange where they can resurface the disc for two quid. Not only will it make it look better, but it'll make it more likely play.
EDIT: Or if you can't get your money back, and if the above doesn't work, you could also contact the game's publisher. Most games companies will replace discs for a fee less than buying the game again. EA charge a tenner to replace a damaged disc, for example. Though that really is a last resort.0 -

The seller has offered a refund once I have sent it back to her (recorded).

Request a refund, if she wont give it report it to eBay as 'item not as described', but when you return the game to the seller make sure you send it through a recorded delivery system, get proof of postage etc etc, so that she cant say she didnt recieve it.0

As a tip for anyone selling Cd's, Games, Dvds etc that have been open, I suggest removing the disk and wrapping it in kitchen towel before placing it back in the case.
I used to buy DVD's a few years ago from Canada (where they were much cheaper and came out earlier) and they were always sent this way and never got any damage as unfortunately disks sometimes seem to leave the stud in the cases whilst in transit.0
