CSA - Ex Making A Claim Against Me Now

    As the case is on screen, she has definately put an application in, but it has been set to direct pay immediately. Seems strange she has done that without having an assessment completed first, the only logical answer I can think of is that she was afraid your changes in life may have resulted in payments ceasing and just wanted to have the csa doorway open (cannot see how it would be any quicker than applying if that event actually happened), or it is just to show to the other benefit agencies there is a maintenance agreement.

    Ineresting that because he said exactly that ! He also went on to say that the originator of the claim has authority to do that and I couldn't so I just said OK but I doubt she would do that :(

    Anyway, I have sent a letter to my MP tonight, so hopefully I can get some more advice on this.

    If the PWC instigated the case then only they can close it.

    I can't help thinking something is not right here. You need this case closed and the sooner the better.

    Just going from my experience here... In my case I have a file and the ex has a file... Just recently something was showing on my file that had not been updated on his file until I queried it and they opened his file to have a look... It might be that she's called them recently but the wheels turn so slowly, nothing has been entered on your file?
    A very proud Mummy to 3 beautiful girls... I do pity my husband though, he's the one to suffer the hormones...

    Well, I asked the guy about 3 times if there was anything I needed to do or if there was any information that I had to give but he said no there was nothing on my case, so I have no idea where things stand right now.

    All I know is that she went to the CSA, got nowhere with them and then came to me for the money in which I paid her directly. She has then since gone back to the CSA because she basically wants more money or has been told she could get more money, but it seems she hasn't really been following it up that much by what the representative was saying yesterday. It all really didnt' sound that urgent, he was very pleasant with me and we even shared a some chit chat? As I said, I really don't know what to think or what is going on, but I just think that the CSA must not see this as an urgent case because she IS getting money and quite a considerable amount at that and has been for the last 4 years. I just have to see what my MP says now I think.

    I really appreciate all the advice from everybody here, you have been a fantastic help and if anything gave me that kick in the bum to do something about this.

    To try to answer your first question Lizzie, from what I was understanding by the CSA representitive I spoke to last night, he suggested that if the person does not continue to pursue the claim that then they won't carry out an investigation. He told me that she had not been in contact with them recently but he didn't tell me when she last contacted them. He said as long as everybody was happy things should stay as they are. It's strange because it "felt" that he was more than aware with what was going on as he had the case up on the screen? Therefore the CSA "must" have been made aware by her that she was receving money from me for child support.

    If a case already exists, then unless the PWC calls them to say that you haven't paid, then they will assume that you have (as they have your case in existence on direct pay). The PWC can go back to them and say that she hasn't been paid, but cannot go back too far as the CSA will tell her that she should have contacted them sooner. From what you are saying, you are fine and have nothing to worry about!!

    I have still written to my MP just to make absolutely sure. I'm glad you think that things may be ok.

    Your quote absolutely ties in with what my ex said in one of her emails to me that I must tell her immediately if I intended to stop paying or not. Infact, you've just made me realise something, I think my ex actually wanted me to to stop payments you know so she could have taken that excuse to take to the CSA, I think reading between the lines (and by her reaction in her emails to me) that she wasn't actually happy about me not stopping the payments (she practically was urging me to), this would have given her the necessary platform to force the CSA to investigate.

    Based on what everybody has said here and then what the CSA representative said to me, i've summed up this conclusion:

    ...that my ex wife decided she would try and get more money, and to do this she had to have an excuse to "break" the agreement we made (and from what appears the CSA have always known about otherwise the representative yesterday surely would have said I was being investigated and needed info off me). So she thought she'd play mind games with me in the hope that I would react badly and fall into the trap of stopping the agreement giving her the exact reason to tell the CSA that she needs money, however, it backfired on her because she didn't expect me to actually not stop them, so after I told her that in an email, she then didn't really know what else to do other than try to entice me more into giving in to it but I didn't.

    I am not sure what one could say to the CSA after first telling them that they had an agreement in which they were happy with for a number of years only to then decide they wanted to break it because they thought they could get more using the CSA.

    I will keep you posted on what happens with the letter from the MP.

    I received a letter from my MP already:

    "Thank you for setting out your situation so clearly. I agree that you
    need to keep good records of agreed maintenance - the email from your ex
    wife and bank statements are essential.

    It is difficult wondering what the CSA will come up with. However, you
    seem to have kept the evidence fir if and when it contacts you. There
    may be arrears going back to June or whenever the financial assessment
    is dated from, but what you have paid must be taken into account - it is
    just that this may be less than the quantum arrived at from the
    assessment.

    I will be happy to help you should the need arise.

    Yours sincerely"

    Seems like they are quite supportive should anything arise from this. So now I still need to know what else I should do bearing in mind that I can't go directly to my ex, so now I feel like I am in limbo and having to "wait" for something to happen before my next course of action. Scary.

    Well if you can't approach the PWC there is not a lot you can do i suppose.

    I must say how lucky you are to have such a CSA conversant MP who responds so quickly in a busy parliamentary week with the Queen reading the next parliaments business and all this normally entails.

    Good to know the royal mail are so timely as well.
