If no CCA and I still pay how will this affect me

Good Evening Everyone,

I was wondering where I stand as I have sent CCA requests to a couple of my credititors and they have replied by sending me a copy of their terms and conditions and the consumer credit Act.

Having read the information on this site I realise that these debts are therefore, unenforceable and whilst I still owe the money they are unable to puruse me legally. my question is however, I owe this money and therofre feel I am morally legally obliged to repay it, I just wondered if I am doing the right thing as I am on a DMP with payplan and if there could be any sort of backlash from the creditors as I am continuing to keep up the repayments, all be it greatly reduced.:eek:

  • It will show you are a decent human being. Creditors will always want their money back and may try to force you to pay higher repayments if they do just remind them they havn't got the CCA. Its so refreshing to see someone taking responsibility for themselves and not looking for a loophole. Well done.

  • I'm in a similar situation. I have a couple of uneforceable CCA's but am still repaying the debt via CCCS. I requested the CCA's as I was worried about court action. It puts me in control and not the creditor.

    Broken hearted for your kind words.. My philosopohy is I spent it therefore, I must now pay it back..

    Deep in debt thanks for the advice it is good to know that No CCA can be used as a bargaining tool, if any of the creditors get heavy..

    I want to remember the harsh lesson of being in debt forever, so when I get myself debt free I can remember just how awful it felt. The laughable thing is I only accumulated most of my debt by servicing one debt with another for years...:eek: Should of sought help alot sooner. isnt hindsight a wonderful thing...

    This is very important and worth remembering, as you've requested CCAs this has placed your account into dispute, the DCA / Creditor CANNOT pass your debt on to anyone else, if they do inform the new DCA / Creditor, they have no right to contact you, due to your account being in dispute with xxxxxx

    Just because someone uses a loophole to their advantage does not mean they are not a decent human being :rolleyes:

    When a creditor uses whatever is at there disposal by taking a debtor to court to obtain a charging order for an unsecured debt, is that right?

    Do you have any idea the stress / anxiety that process can create?

    I have no problem whatsoever with anyone using a loophole to their advantage when creditors don't treat the individual with respect.

    And yes, the person I'm referring to (not me) has been paying the creditor on a regular basis.

    Each case on it's merit, you really should stop being so judgemental.

    Longing to be debt free - My OH is in the same position as you. We have requested a CCA, even though we have been making payments for over 2 years (long story, DCA basically wrote to us demanding money, and we bent over no questions asked. We don't even know what this debt is for, hence the CCA request). If you're concerned about damage to your credit rating, I was told that if a debt has been passed to a DCA than the damage has already been done via the original default.
    Please continue to hold the line. Your call is very important to us and will be answered by next available robot...

    Longing - If you are making the payments you agreed with them, there will be no backlash. I would however request of these companies that they stop adding charges or interest if they have not already done so.
