If a travel company booking on line promise to "hold the holiday for 24 hrs" for you(as discussed in detail on telephone) , but you get back to them in (say1 hr!) only to find this has "now gone", is there any form of recompense?:confused:
(4 of us already travelling and wanted to add a 5th, which we were promised at the same price and was "on hold" so we could confirm with that 5th person-- but then told it was "gone"!!)Any advice out there??

    No, you have no contractual relationship and therefore there is no right to compensation.

  • Unless you had done something in return for them to hold the holiday - say, booked the other four - then there would be good consideration and a contract. It's not clear from your post whether this is the case.

    Yup you can claim back every penny you have given them, ooooh hang on you havent given them anything for the 5th person, how would you feel if you had'nt got back to them and they tried to get some recompense from you?

    This would not oblige the agent to hold a place/ price for an additional person. This would either be a separate booking, or a variation of the original contract. In either case the agent only needs to honour the price agreed at the time of payment/ confirmation by the customer.

    A contract for four holidays and an option to purchase a fifth holiday at the same price within 24 hours, all in return for a certain amount of money paid now would be a perfectly valid contract under English law (subject to all the other provisos - capacity to contract, willingness to enter into a legal arangement, etc. It's unlikely that this is the nature of the contract struck, but it could be. The OP isn't completely clear.

    I know nothing of the sort. Please don't make assumptions about what I know.
  • No recompense, but rubbish of them.

    When you do book, don't give them the pleasure of your business, that's the best you can do out of this.
