MBNA credit balance on card

Hi,

Having been recently stung for late payment sharges by MBNA and then losing my 0% BT rate and having to fight to get them back but no luck yet on the interest they charged me I would like some advice in the reverse scenario. In Feb 2007 I was sent a statement for another MBNA card that I had settled but had a refund posted to it for approx £9.00, as I put the card away I forgot about the credit balance but MBNA don't appear to have either refunded the money or sent me any further statements, am I entitled to charge them late payment fees at say £12.00 per month for 21 or 22 months plus interest?? I am sure if the boot had been on the other foot they would charge me wouldn't they?

I should have bought something to wipe the balance down but as I never intended to use the card again unless I needed another BT I just put the card somewhere safe and left it.

  • No, you're not entitled to. They've got a signed contract saying they can charge you xyz if you don't make a payment - you cannot then turn around and apply the same to them, as you have no legal right to do so.

    You can't complain about them having your money when you could have had it back at any given time. You could have used the card or even closed the card and requested a refund be sent to you, but you chose not to.

    Fortunately we are lucky enough to have a choice.
