Inferior substitute tyres

My brother recently purchased a brand new car and asked the dealer to change the wheels from 17inch alloys to 18inch alloys. He paid the dealer the princely sum of £1200 to do this.

In the recent rain he has noticed that the car has not been holding the road well and so decided to check out the tyres on the new alloys. It seems the tyres are the cheapest possible.

On querying this with the dealer he was referred to the company which fitted the wheels and tyres. Their response was that he did not request a higher standard of tyre.

Now when the original wheels were removed they had the higher standard factory fitted tyres which the fitters kept.

I think that my brothers arguement is with the dealer rather than the company which fitted the new wheels and it is up to them to supply the same standard of tyre on the car. If the dealer then wants to pursue their subcontrator then that's up to them.

Can anyone advise me if my theory is correct and what action my brother would have to take if the dealer refuses to budge?

    Assuming that the 18" wern't a factory option (in which case they should have the OEM rubber) then, if he didn't specify a tyre & just said 18" alloys then the dealer/tyre shop have fullfiled the contract. Unless the tyres don't have the manufactures recomonded speed rating I think he's out of luck.
