Hardship claim rejected

Hi, new here so bear with me ;) .

I sent off my claim to Barclays, for £1100 of charges over the last 6yrs, I'm on incapacity / housing benefit, & reliant on my parents bailing me out (humiliatingly) The long and short of Barclays response was "No, we dont have to, so we wont & we think thier fair, wait until the test case is determined". Basically the same "f*** you" attitude I've been getting from Barclays for the last 22years, but have just accepted as the "norm" from banks.

But have sent the financial statement / planner to me nonetheless!

Anyone been paid by Barclays v recently?

  • its obvious you are in financial hardship tell them your gonna take your case to court then they might start listening to you its worth a try good luck

    I've got a stayed case against them for about 4k. I have one lot of their solicitors chasing me for £600 on an old account, I have a different set of their solicitors threatening me with eviction over a First Plus (previously Barclays First Plus) secured loan that is 2.8k in arrears.
    If anybody should know I'm in hardship they should but I can't be a***d wasting my time asking because I know it will ba wait for the test case.

    i thought that through the fsa regs they pretty much had to. am seriously starting to fall out with barclays now!!!

  • Ah Barclays being the nasty clowns Ive found them to be (over 3 major complaints, them taking money they were not entitled to, a fraudulant direct debit from my account, nothing to do with me, taking money for a barclayloan insurance after i left the box blank to say i didnt want it -the manager had ticked the banks copy after my TOP copy had been removed, which I had!!!!!! Took forever to get refunded! as they stated "i had the benefit of the insurance though" lol, yeah STEAL my money, commit fraud on my account, but say "its ok"!!!)

    They included the line "If you issue a claim against us we will immediately apply for an order to stay your action until resolution of test case" I found that line singley more offensive & insulting than the rejection itself. The rejection was just predictable & being Barclays typically patronsing.

    Will send off the form, but I can soooooo easily see them saying, we wont include your tv lisc, water, car tax & insurance as your paying your parents back for them, not companies direct (they paid upfront, so i can repay them at more affordable rates, naturally I have to repay them)

    On thursday I got a payout of £477.50- 50% of the last three years charges. I had my first claim rejected, but after phoning them on 0845 3000442 several times, finally got through to someone who listened and explained I was in FH- Barclays had shut my overdraft off and were issuing notice of closing my account! Anyway, the same woman who got me the pay out also arranged for my overdraft to be reinstated, so now I'm back under the limit. I guess my advice is to keep calling that number until you get through to someone who is willing to listen/help!

  • Please can people not advise posters to take their bank to court on hardship grounds. What this will do will be to give the banks an opportunity to have the case stayed. There is no actual LEGAL grounds for a case to be heard on that basis alone. Please read my signature and write once more to Barclays. Annex 2 is about financial hardship. State why you are in financial hardship and name the conditions specific to you. If they still remain in their view then take your case to the Financial Ombudsman Service.

    worth saying again. courts will stay all cases of bank charges. take financial hardship cases to the financial ombudsman service. you may not get paid out but they may be able to help in other ways.
