Amazon Marketplace and Miss prices

As I had said in my other post the contract is from YOU to THEM only half is formed.
It isn't a "complete contract" unless it encompasses both sides, it is an incomplete contract. I made my half with the offer to purchase the items at the marked price, they made their half with the email, and completed the contract in writing.Amazon is a larger company and therefore could absorb most missprices with no problem and can also avoid any bad press/ unsatisfied customers. Marketplace is individual sellers who Amazon have no real control over and therefore by using a disclaimer they cannot be held accountable for these sellers.
i would agree with you, but Amazon exempt themselves from the miss pricing thing by saying it is not a contract, that is what every miss-price case history I can find says, it isn't a contract until dispatch beciase the confirmation says so. In this case, Amazon puts the seller at risk by saying this is a complete contract.
If I were a seller, I would be extreamly unhappy by this wording!0
