I think I am covered- am I??

I bought an item from ebay on the 26th october.

It never arrived.

I contacted the seller who was adament she sent it- I don't think it was recorded:confused: I have seen parcels left outside my front door before (mainly freebies) when they don't get recorded, and if so, could mean the parcel would have been stolen- Basicly I trust the seller sent it!

But anyway! I contacted the seller who said she will send me the proof of postage so I can claim back the £36 from the P.O.

Its been a week. No letter, no P.O slip. I have checked the address with her, its all fine.

Its now the 26th November, 31 days after the auction ended and also 31 days after I have paid. I still have 14 days left with paypal to claim back any money- is this right?

I don't want to harm the seller's ebay ratings if they have done nothing wrong so am prepared to sit out the postage until the 28th (It could be the seller has sent it as they say as we get really poor post here- I often only get post two days per week, despite stamps being dated otherwise, think its just staff cuts.)

    Its down to the seller to claim from the PO, not the buyer.

    I'd politely ask for a refund in X days and if that doesn't happen put in an item not received dispute.
    Seems to me the seller may be stalling you so that your 45 days run out to put a claim in. Don't let that happen!

    Personally the moment the seller told me to claim for my losses I would have hit them with a paypal chargeback. The seller doesn't understand ebay so protect yourself and put in a full chargeback TODAY. Don't wait any longer, the seller might be trying to push you over your 45 days.

    Start an item not received claim immediately!!

    YOU didn't send the item, so how on earth can you claim from the post office??

    Don't be nice, as this seller sounds like an idiot, so you'll end up with no item and no money if you don't act now!

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Is there a link for this? (or other useful information?), as searching via eBay it just says contact seller, but if there are still problems then:

    There's no link; it's just logical!

    YOU can't actually make a claim, because YOU didn't physically send anything in the post. Only the seller can make the claim.

    It's the sellers responsibility to make sure the parcel gets to you, and if they can't prove that (i.e. it arrived and you signed for it), then it's their problem to sort it out.

    Now, go put in that dispute before it's too late, and don't let the seller tell you otherwise. It's definitely lost in the post, as it should have arrived by now, so you need to claim straight away before it's too late. and it is THEIR responsibility to claim from the royal mail!

    Yes it is the sellers responsibility just as it is up to Tesco to deliver your goods or refund if they fail to arrive.

    The only link you need is the final one in your own post where it takes you to a paypal chargeback where a buyer can be guaranteed their money back if seller can't prove delivery.

  • Thanks soolin and pinkshoes for clarifying the matter. But another question about DAMAGED items, if the DAMAGED item is with the buyer, what happens? Is it the SELLER'S responsibility? What are the best options in asking for a full refund (cost of item+pp - minus buyer's return postage)? (before this gets to a dispute via Paypal)

    That's why I asked for a link as the seller seems to think it is the BUYER'S responsibility etc as item is with buyer. And also to direct seller to this link. :rolleyes:
  • Although in my opinion the seller should immediately refund and claim for compensation themselves, Royal Mail will accept claims from the addressee/buyer/recipient http://www.royalmail.com/portal/rm/content2?catId=69800733&mediaId=80300735

    Whoever submits the claim needs to have the POP and details of where it was posted.

    Thanks for the replies- got hold of the buyer- she hadn't even sent out the postage slip yet!! I am not sure how many days royal mail will let a claim go through with, I have -and I must be having a very good day here- given the seller until monday to get it to me or I go via paypal. I can't believe she still has the postage slip- its nearly 2 weeks since she said she was going to send it!!

    I think my soft spot for other home sellers (as oppose to business or mass sellers) is not working out so well- maybe I need to rethink my morals!
  • Very commendable attitude. When we have buyer that shows this level of cooperativeness they get super dooper dooper super service.
