Here Is Our Soa...ready For Bankruptcy ANY ADVICE

    what a great xmas pressie we are now officially BANKRUPT,we did our soa ourselves in the end ,i don't know why we were so worried our court was really helpful and the judge was lovely.we got a call from official receiver while we were there and they said they would contact us with in 2-3 weeks and i cant wait for that now!
    our bank accounts still running online so i take it they not frozen yet and i put a phone contract in it too and am still using it so will this be frozen we we speak to official reciever again in 2-3 weeks#
    also judge said why did we move out our house so i take it i may be able to speak to our mortgage company as they still think we living there(god what a sitution)the or said i can to speak to the examiner on thursday about this as i believe we are in negative equity so now hoping we could go back to our home!i know i was silly to move out but with 3 kiddies ,xmas busy working i could not cope with all the letters and phonecalls with threats of baillifs

    anyway these were the figures we put down on our soa in the end,as i decided with alittle help from our head teacher i should be at home with my kids as they all behind at school and she wrote a letter ready stating this so here goes;;;

    what do you think
    when will accounts stop working on internet etc

    Hi Looney,

    I'm glad BR went well for you.

    You should be able to move back into your house and sort out the arrears with the mortgage company.

    Also it's worth knowing that they can let you spread the arrears over the remaining term of the mortgage, so you'll hardly notice.

    We've just come to an agreement with our mortgage company, we have £5000 ish of arrears and all we've done is not reduced the amount we pay from the recent rate cuts, so paying back the arrears isn't costing a penny more.

    I'm just sorry that you were so badly advised to leave your home.

    yes me too , would recommend not listening to bankruptcy firms they just after your money like every one else,they really didn't help and yes we are in about 5000 arrears too but i am with mortgage express and not sure if they will help us or not as my dad paid 6 months rent upfront so really need 4 month payment hols to so my dad gets his rent back atleast what do you think our chances are with that!

  • so how long have you been bankrupt then and how long did it take for your mortgage company to help with this

    We've been BR since March.
    We had a few letters politely telling us we had arrears, then one telling us we needed to contact them, then one saying they were going to issue a default notice (which they didn't). When we phoned them we told them we were BR and things are a bit tight at the mo, they asked how much we could afford, we told them the same as we've been paying before the rate change, they said fine, I got confirmation today that arrears will be paid off in July 2012.

    I think banks are falling over themselves to help at the moment, if the don't strike a deal with you they'll be saddled with a property worth less than you owe, at least if they co-operate they'll still be getting something.

    Could you offer to pay the difference between the rent and mortgage for the next 4 months, then go back to full payment once your dad has got his money back?

    Congratulations - that's great news about the house! I would say, though, re your bank accounts - you shouldn't use them at all until the OR's given you the all clear, even if they look like they're fully operational online. You could get a severe telling off by the OR (although I'm not sure how cross he will actually be!) - better to be safe than sorry! CBx

    Things Going Fine This End,we Had Our Interview On 8th Jan He Nice Chap.we Told Him We Moved Back Home To Our Mortgaged House And He Was Absolutly Fine With That I Told Him Our Soa Would Change But He Said He Dont Need To Know As He Knows We Trying To Keep Our House,also Had It Valued Over The Past Week And It Looking Good For Us As Is In A Little Negative Equity...still Trying To Come To An Agreement With Mortgage Lender Though On Arrears But Still No Legal Action Taken We Have Missed 5 Payments But Are Gonna Pay This Months Whoop Whoop.so Hopefully When We Done This They Will Agree To Either Interst Only Or Extend Our Term...also Husband In Need Of Public Liability Insurance But No Joy They All Ask When Will Be Discharged But Cannot Understand As This Was Personal Debt And Not Business Any Ideas.
