Comet - Faulty notebook... what are my rights?

Hi,
I am hoping that someone out there can help.....
Brought a Acer Notebook from Comet on 14th Novemeber. May partner just wanted it to surf the net, emails and skype. We were told by someone in Comet that it would be ideal for what we wanted and that it wouldn't need any virus software as it was using Linux and the virus' were only aimed at windows(?) Anyway they didn't have any in stock so went to another comet. The salesperson told us that it definately would need virus software and that we had been mis-informed.
Anyway, partner used notebook 3 - 5 times and it would freeze leaving a grey oblong on the page, it said that it didn't have enough memory (even though we hadn't downloaded anything onto it!) and when shutdown pressed, a couple of times it didn't shut down.
We decided that we probably needed something a bit more robust and decided to by a laptop instead so took notebook back to Comet the following Friday and said we wanted to exchange it and spend some more money (an extra £300) on a laptop.
They said that they couldn't exchange it as we had reported a fault it had to be sent to Acer for them to authorize a refund. To make matters worse the woman just didn't care and was rather arrogant and ended up fueling the situation! (you would think that they would jump at the opportunity of making an extra £300). On Friday I spent 2 hours on the phone and ended up taking the notebook back to comet and was told (by head office) they would try and do something with it. I get in there speak to a man just as arrogont who spoke to Acer and had to download something onto a flash drive. I stood there 20 mins and it had hardy downloaded anything so I decided to leave it with them. they rang on Monday afternoon saying that they had downloaded whatever they needed to download but couldn't test it as they didn't have access to internet (?) so I could come and collect it and test it at home (another 40 min journey each way) or I could authorize one of them to take it home and test it. I spoke to head office and said I just wanted it left alone at the moment (I don't care if it works or not I JUST WANT A REFUND!!)
Since then I have been on the phone to Comet head office & Acer. They have told me that it has to go back to Acer to be checked and if it is a software fault and they can fix it then we are not entitled to a refund or exchange. If it is a hardware fault then they will authorize a refund.
Can anyone help as I am just about to get head office to arrange collection back to Acer.:mad:
(by the way, we were so disgusted with comet we went round the corner and brought a laptop for £500!)
Sorry if I have rambled on abit, just wanted to get down all the info (there have been a few more calls to and fro but nothing of any substance came from them).

Not too sure what the technicals of this are but the basic position is that if it is faulty, then yes, you are entitled to reject it and ask for a refund.0

But you bought the notebook with software on it presumably? Therefore you bought faulty goods.0

Faulty, not fit for purpose, reject goods under the sale of goods act, don't let them fob you off with their T&C's as they can not override the SOGA. As Tozer rightly said, makes no difference if it is software or hardware, machine was supplied with both to work out of the box, this it no longer does so quite within your rights to reject the goods.0
