Bought Watch Online From US - Lemon Arrived!!

Hi All,

I bought a watch from a US based supplier and it finally arrived but was definitely not the same item as described.

The company refuse to get back in touch and I have emailed them several times.

Just for my peace of mind - Is the credit card company liable for this and if so how should I proceed in telling them that I am unhappy with the item?

  • There is case law suggesting that Section 75 of the CCA does cover items purchased abroad.
    You don't say what is wrong with the watch so is difficult to say where you go from here.
    To get a refund you may have to send the watch back at your own cost in a track-able/secure manner.
    Is it worth it?

    Hopefully you're not too bitter about it :D

    Section 75 does cover overseas purchases. With the little info provided it's difficult to say whether you are entitled to use the CCA, but if the watch received is not that of which you ordered then it could come under 'misrepresentation' which is a legitimate reason to claim.
    If you are entitled to claim, then the retailer and the card company become jointly liable.
