Barclaycard and Lowells

Hello All



JUNE

Started with letters and phone calls off lowells saying I owed £2350, an old barclay credit card debt that was originally £1000.
I made the mistake of getting in touch and paying them £100 off the debt, we arranged to pay off £50 a month until it was cleared.

JULY

They said pay us £1500 settlement figure and that will be the debt payed off in full, I thought that sounds alright, I said can you put that in writing, the lad from lowells said when its payed he will push a button on his computer and that will clear the debt.

I thought that sounds fishy, so took advice from moneysaving.

AUGUST & SEPTEMBER

Just generally stalling them hoping they would go away, no chance.

OCTOBER

Sent them a Cca (think thats it) advice from moneysaving forum with an excellent pre typed letter and a pound postal order.

NOVEMBER

Gets a letter this week saying they have been in touch with barclays and our trying to get my details retrieved from the archive, the second and third paragraphs are scare tactics about how they might look for even more money blah blah etc.

Then the fourth paragraph which was a bit of a shock, they said, give us £940 and we will take this as final settlement, now do you think they have seen their !!!! and cant find this paperwork?
What should I do now, thanks in advance.

    Well if they can't find a valid CCA (Consumer Credit Agreement) then the debt becomes unenforceable so you don't actually have to pay them anything.

    If they do find the CCA, then at least you have the offer of a Full and Final Settlement in writing which you could take up.
