Can they do this - play.com

Hi - I placed an order today with play.com for an offer on their website - a nintendo wii bundle and I ordered it, they were advertising it as a special offer price of £80.01 including VAT and delivery. They have now cancelled my order though stating 'price discrepancy' and if any monies had been taken they would be returned within 3 working days. I have an order number and confirmation emails of my order - can they do this or should they not have to honour the price?

  • Yes they can do it.

Some companies will offer to honour the price as a gesture of goodwill but if there is a genuine error, they are under no obligation to sell the item to you at the wrong price.
  • In short, yes they can do this.

It was pretty obvious that an error had been made.
    .....

  • yes am afraid they can, there is a lot of mispricing going on at the moment and it seems the stores dont have to honour them. Check their terms and conditions am sure they have covered themselves in regard to this. Sorry, you can always ring them up and hope they will make an exception I did this with Amazon recently and got my goods for the price advertised but it dont happen often as far as I am aware.
  • That a shame I knew it was too good to be true - oh well not as cheap a christmas present as I hoped it would be.

    From the terms and conditions:
While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Speaking for myself...........and i am unanimous in this...... what i think is wrong is having to wait 3 working days before you get ya money back!
  • Yes i agree with you, also by experience this 3 days tends to be 5-7 days, this is also what they have informed me i will have to wait for my refund for yesterdays Hewlett Packard printer saga!
  • Yep they can its called an invitation to treat!

  • Surely if they've taken the money, the contract must be honoured?
  • but OP stated it was diaplyed as a 'special price' - surely that would indicate (to me, anyway) that would have had to have it approved, before it went online? i bet they wouldnt cancel an order or refund difference it was overpriced 'by mistake'..?
