Can I claim Incapacity Benefit

Hello,
I am at the mo 23 weeks pg and my baby is due at the end of april.
I gave up work in March 2004 as I was pg with my son, I was able then to claim MA of 102ish p/w.

Now I have heard that I might be able to claim Incapacity Benefit for 8 weeks when my baby arrives. Is this true? does anybody have a link for me? as this is all new, I believe I could maybe claim as I have worked and paid NI in the last three yrs.

  • Deemed Incapacity.
    If you are pregnant or have recently had a baby AND
    -you would not be entitled to either maternity Allowance or statutory maternity pay were you to make a claim AND
    - you are within a period beginning with the first day of the sixth week before the expected week fo the childbirth or beginning with the actual day of the childbirth if that is earlier and ending of the 14ths day after you have had the baby. AND
    -you have a medical certificate giving your expected date of childbirth or your actual date of childbirth.

    So it may be worth investigating this further as 8 weeks IB are available.

    Incapacity Benefit

    for women who have paid some National Insurance contributions during the last three years, but not many recently
    What is it?
    A weekly allowance that can be paid to women who don’t qualify for SMP or Maternity Allowance.
    Who gets it?
    You get Incapacity Benefit if you have enough National Insurance contributions in earlier tax years. Claim if you paid National Insurance contributions

    during the last two tax years that do not overlap the current calendar year. Your local JobCentre Plus will work out whether you can get the benefit. If you have paid any National Insurance contributions in the last two or three years you may qualify. If in doubt, claim.

    Make a claim for Maternity Allowance (see above). If you are not entitled to it, the JobCentre Plus should check automatically to see if you can get Incapacity Benefit.

    How much is it?
    £55.90 per week from six weeks before your baby is due until two weeks after your baby is born.

    A Sure Start Maternity Grant may apply to you:

    A Sure Start Maternity Grant is a one-off payment to help with the cost of things for a new baby.

    You should be entitled to it if you or your partner recieve:

    Income Support
    Income-based Jobseeker's Allowance
    Working Tax Credit (Must Include A Disability Element)
    Child Tax Credit (Must Include More Than The Basic Family Element)

    If YES to one, claim a Sure Start Maternity Grant.

    We use partner to mean a person you are married to or a person you are living with as if you are married to them.

    You do not have to pay a Sure Start Maternity Grant back.

    You can claim from 11 weeks before the week your baby is due, until 3 months after the baby is born.

    If you are adopting, your baby must be aged under 12 months. You should claim within 3 months of adopting.

    A Sure Start Maternity Grant should be £500.

    To claim contact your Social Security office for a claim form.
