He said he went round to the residence last night after being fobbed off all day, and got there to find all the appliances gone and my flatmate hiding under a blanket on the sofa!

So the LL just let himself into the flat??! He needs to watch he doesn't get done for harassment. If the dodgy tenant is clever he may hold this against the LL.

Also was your deposit protected? If not, he probably hasn't protected the dodgy tenants either and the tenant could use this against him too.

This all sounds very starnge. I cannot believe the LL gave another 6 months lease having never received any rent for the first 6.

It sounds like you will be held liaible for the rent and then you would have to take your ex flatmate to court. It is in the landlords interest to persue you as he has more chance of getting his money from you, You are in a really bad position and it's not fair, people like your ex flatmate have no conscience and your ex landlord quite rightl wants his money, any way he can.
A similar thing happened to my DH a few years ago and he ended up paying all that was due even tho the partner had vanished. It was business premises though so may be different

as another point - how did you pay the council tax ?, if you paid it via your flatmate have you ensured it was paid ?
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    It does sound really suspicious.

I definitely wouldn't be talking to the landlord or admitting anything until you take legal advice. It may be the landlord knows your ex-colleague is ill so knows they can only get the rent off you.
    I'm not cynical I'm realistic :p

Trust CIS to think of Council Tax!!! But he is correct, council will chase you for it if it's not been paid.
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

Too much time spent in council tax recovery...

  • Very strange indeed.
As everyone else says, why did it take 6 months of not receiving any rent at all for the LL to chase you? And after that, knowing that your ex flatmate was not trustworthy he still went ahead and signed another contract for a further 6 months?

I would write to the LL and ask for prove that he didn’t receive the rent and also, has he actually explained why it took him so long to notice that he wasn’t receiving any rent?
Have you asked your ex flatmate whether he did pay the rent or not?
And get the Police involved ASAP

How could the LL prove that?
