Cifas Cat 3 & 4 - Please Help!!

Hi, I am a newbie, and this is my first post, I am in desperate need of any help that you can give me. In May I opened a business account with A&L, then in July I applied to open another business account this was declined and within a week my first business account was closed and a cheque sent to me for the balance. I rang A&L, but they refused to tell me anything saying that I had to write in, I did this and never got a reply. Around about this time I took out car finance through Black Horse. I then took a look at my credit file, where I found 3 CIFAS warnings from A&L, stating that I had applied for an account with falsehoods and the facility was declined. I did further diggin through CIFAS and found out that a firm of solicitors had registered a CCJ against me at an address of my ex-partner where I had never lived. I wrote to the company concerned and they refused to remove the CCJ despite my protests that it was nothing to do with me, and that I had never lived at that address, they refused to budge, saying that the court would mark it satisfied, as my ex-partner had since paid it. I searched my file today, and noticed that Black Horse have made a number of searches, I then scrolled down the page to see that they had put 2 CIFAS warnings on me stating material falsehoods facility granted. I have written to the county court to get the judgement set aside as I have never lived at the address i question, hence why would I declare this address?? I am waiting to hear back from the court. WHat I need to know from you guys is, can Black Horse terminate my agreement? and how can I sort this mess out. I have 2 mortgages and a 9.5k overdraft and I desperately need this sorting out before the situation gets any worse. Sorry for the length of the post I just felt that I had to get all the info in. Please help!!!:confused: :mad:

    have you phoned cifas? and explaned your situation.they will give advice.ther very helpful
  • Hi, I contacted CIFAS, but they said I had to contact the company that had listed the warning, which I did, but A&L have not replied.

  • The finance you have taken out with Black Horse will be ok as long as you keep up the repayments.
    They may well have marked your account/file to take quick action if the account gets into a default situation.
    It looks like they may have discovered the cifas after the underwriting decision was made.

    Clearly this needs to be resolved as soon as possible so that the cifas markers do you no further harm.

    Are you sure about the CCJ - as it seems to be the heart of the issue?

    I am thinking if you did not owe the debt that was taken out then there may be an element of fraud involved - from your ex-partner?

    Each Financial Institutionhas two or three designated persons that would deal with cifas warnings and it may help if you could get to speak to them direct on the phone?

    Both Financial businesses believed you lived at the undisclosed address where the CCJ is registered and I suspect you will need to give them some proof that you never lived at the address and proof that the CCJ was wrongly registered against your name.

    If you can sort the CCJ and then go back to both companies with your evidence - you then should be able to get the cifas warnings lifted from your credit file.
  • Thank you for that, it is a relief that the finance will remain with Black Horse, it was really worrying me.

    With regards to the CCJ, as I have bought a property with my ex-partner before they automatically assumed it would be a joint purchase again, hence a CCJ in my name. There is no fraud issue there at all, I am sure of that.

    I have written to the court with proof of my address at the time of the CCJ being placed at the other address, I have also sent them proof that the solicitors concerned were fully aware of my current address as I have bought 2 properties through them since.

    Hopefully, the court will set judgement aside, as I believe it is a valid reason if you have proof that you weren't living at the address.

    If I get the CCJ removed will I have to go to A&L and Black Horse or straight to CIFAS?

    Do you know how long this process will take?

  • I think you will need to go back to each organisation with the proofs and request that they remove the cifas markers and ask them to confirm in writing to you that they have done this.

    It should not take long once they have the evidence.

    Once all done, request an updated copy of your credit file from a credit reference agency
