Hire Purchase credit agreement - mileage mistake - please help!

I have been today to sign the finance agreement for my new car at a dealership. My boyfriend did all the negotiations and got me a deal I was happy with. We stated as part of it we wanted a quote to include that fact I would do 14,000 miles a year. I was then asked to return a few days later (after they got the registration number for me) with the insurance certificate and ID to sign my credit agreement. I went on my own (big mistake!) as b/f was at work and was given the 1 page credit agreement - I checked it throughly and it matched what we agreed, signed a direct debit agreement, and was given back my id documents and my copy of the creidt agreement.

When I got home I handed it all over to b/f and he checked all the paperwork and pointed out that on page 2 of the credit agreement it stated 10,000 miles a year with an excess mileage charge over this (I will never be able to stick to 10,000). This was on page 2 of the agreement which hadn't been shown to me (I signed page 1 and this was the only one I was handed initially) and page 1 doesn't say anything on it to indicate it was page 1 of 4. I am really cross with myself for not realising there was more than one page but also because the other pages were not handed to me. I am not due to get the car until friday and I know because I signed in the dealership I have no cooling off period to cancel but wondered what my rights are given:

We asked for a quote with 14,000 miles per year (this was written down in our information booklet which the dealer has).
I was only given page 1 of the credit agreement before signing and this is the only one to sign.
The mileage was stated on page 2 which I wasn't initally shown but given to take home

Or do I have no room to move with it and am stuck not being able to drive my new car for a quarter of the year?

  • It may be an idea to phone the Finance company and explain the situation.
    Ask them how the deal was proposed by the dealership - was it with 14k pa or 10k pa?

    Tell them that you are unhappy at being misled by the dealer and as the dealer is acting as their agent under the consumer credit act - what are their proposals to resolve this complaint?

    Your other option is to complain to the dealer but it will carry more more weight if you get the Finance company involved as well.
  • check on e 75 (when you on credit 100£ and more ,maybe responsibility can be from credit card company as well,so maybe somebody from bank can stop it.
  • Thanks for the replies. Rang consumer direct who advised ringing the finance company to see if the funds had been released to the garage and they hadn't so was able to stop it. Garage were great too in end - they admitted they made a mistake and we have negotiated something else.
