Hp.... Car Repossession

OK LONG story so hear goes again:D

brought a car from fords with ford credit finance had two years all payments being made, marraige break up made this go into arear's By 3 months Fords then proceeded to court But I had made an arrangement with them before hand so when it went to court it was suspended on the fact I would pay.
anyway in dec last year Fords did away with their Litigation dept and passed or sold the debt to another company, with which I had no details at al only fords telling me they would be intouch with me for payment.

Up until may of last year I had heard nothing and rather than cause a fuss I rand the company after spending days trying to get there number.
I was told by there staff I had to give the car back asap as I had not made any payments to them, I replyed with you have to eforce the fact through the courts knowing I was right as the paperwork was stil in the name of ford credit.
I made 5 other calls to this company asking for a payment bok to pay as I dont have debit card and paying via postal order was more money that I didnt have.
I was told one was on order but would take up to 2 weeks to get to me, so I waited and waited and after another 4 letters to them nothing arrived for me to pay this debt for my car, AND also no replys to my letters to acknowledge receipt.
On the 16th OcT 08 I received notification from the court that the name had been changed on the paperwork to this other company.
So the very next day I wrote another letter stating I am waiting for a paying in book and have been since may 08 recorded the letter.

Nothing again untill this week a bailiff called with a letter they are enforcing the order for the car to be returned, ON THE 26TH NOV 08. I since hen have had a payment book with a letter acknowledging my last letter I wrote how bloody strange was this I thought.

Anyway i called them and they said they were going ahead with the enforcement and there was nothing I could do except pay the whole amount outstanding which I havent got I tryed to explain to them but no go.

I feel now this was all done to stall for time and then to blam e me for not paying

I have copied all the letters I sent to take to court But is there a template tHAT I could have sent regarding them having the debt??????



Desperate now only a few days to go

  • Hi Amber,

    The confusion was likely on the fact that the loan was sold. The lender doesn't really want to repo your car - they just want their money back. So I don't think it was a ploy to "get you."

    I'd keep pushing with the letters you have. It sounds like you are in the UK. I'm not sure what kind of certified mail you have, but get a return receipt of some sort that indicates your letters were sent and received. That way you have proof that you have been trying to cooperate all along.

    And selling debt id fine But the new company must make sure I or the customer has the right details surely

    I think your situation is quite unusual, so I don't think there is a template letter on this site to cover it.

    If I've understood it correctly, you've not made any payments under the agreement for almost a year? That doesn't make your case sound too strong, even if you've been waiting for the payment book.

    Have you tried getting any legal advice, maybe from the CAB?

    Yes I understand But I have offered the money and they said they want the lot outstanding to clear the whole amount not just the missed payments

    No I havent as we can afford to pay it thats not the issue

    We owe 3500 on the car
    I feel they have stalled this until they could gain there name on the court order because now they have replied to my letter only after a name change in the paperwork

    Yes we continued to pay until this was passed on after a year bUT we did make a payment by mistake to fords after them passing on and they passed it on because we didnt know BUT then said they would except no more payments
