What would you do?

About a month ago someone drove into the back of my car whilst I was stopped at traffic lights. We both got out, he was VERY apologetic, admitted liability, we swapped details, he apologised some more then we got on our way.

I went to work that day, all fine. Got home that night, neck really hurt but thought it might have been cos I was on my feet all day and thought nothing more. After hobbling around for a week I finally went to doctors who said it seemed I had whip lash.

The guy's insurance called yesterday and asked, amongst other things, if I was injured. I told them about the whip lash as I know if not I could be done for insurance fraud, but said I had no intention of making a claim. They said they'd put me through to have a chat to their personal injury people, I said no, but took their number "just in case".

I hate the compensation culture and don't want to be a part of it. Accidents happen, after all. But OH argues that as I was injured, I should speak to them. What would you do?

    Personally, unless it stopped me working or cost me financially (physio etc), then I wouldn't claim. Am also not a fan of the compensation culture though...

    You have plenty of time to make a decision - up to three years in fact to put in a claim. It's already been recorded that you have a diagnosis of whiplash by your GP so there's no rush.

    Thanks for your opinions. Normally I'm not into claiming for accidents, but my neck is particularly painful today, so perhaps its got me thinking.

    You're right in that I haven't suffered financially - I get paid for doctors appointments (working the time back, which isn't a problem).

    If I have longer to decide I might see how I am in a couple of months...

  • I was injured in an accident last Monday, a man went into the side of my car and has since admitted full liability. I went to my GPs last Tuesday because I was having twinges in my lower back but since Friday I have been in agony.
    It always amazes me how people who have never suffered as a result of another person can be so self righteous, ie don't believe in the compensation culture.
    Someone hit me; he wasn't looking where he was going; I didn't ask to be injured, but since it happened I have been in a lot of pain.
    I have a personal injury solicitor on the case who is a friend of the family.
    My advice would be to get to the GPs if it gets any worse, get it documented, and get an expert on the case who can advise you properly.

  • At the end of the day, we all pay more for our insurance due to false personal injury claims (amongst other things).

    Me? Luckily I've never been hit by a third party so have never claimed. If I had been? I'd claim, I've been paying for everyone else for years, I'd take my cut.

    There is nothing wrong in claiming as you have been injured, I would. It's upto to you whether you decide to claim or not - as someone said, you have upto 3 three years to claim.
