In a mess

I apologise for length of post and i try start at begining.

I moved into this property after my prev one had to be sold by bank.
I received a one page tenancy agreement and this was taken to council with my hb forms etc.. so i never had a copy.
My top up rent was £50.00 week which i asked to pay via bank as council officer said to make sure i had proof as landlord was "known for this".. off record obvouisly.

After a couple of weeks the landlord trned up for the top up..cash.. i explained prefeered to do it by bank..
anyway i paid cash

still asking for receipt or bank.. no details given.

Fast forward.. i had stopped paying top up as no bank details or receipts so for last 6 months no top up was paid
also my tenancy agreement was not renewed
i explained that hb needed it to pay the rent.. but i still have no copy
also LL phone was always full so no messages was returned and she never answered the phone.

About 2 months ago her son turned up for cash..i explained i needed to pay by bank .. which he agreed to
but i can at the moment only pay £50.00 a week
with £10.00 extra of the arreas..
i have been paying the "£50.00 but he wants an ex £50 every 2 weeks which im struggling to find and he keeps adding onto it

I have some back dated money coming through as royal mail appear to have lost a claim form so once the benefit agency sort it out i should be able to pay a lump of £200
but im really worried they will keep adding it on

do you think i should just say i can pay !"£60 a week thats it?

i dont want to be evicted , i really want to move out as i cannot afford it anymore since my daughter turned 16
i have no money from her or for her.

Will the council say i have made myself intentionally homeless?
i have a form from them so i can go on the bidding list
im just worried that if im in arreas i wont qualify
any help be appreciated

You should have created a receipt for him to sign - and not paid when he refused.

Go the CAB and see what they say.

Why is your topup so high?
  • hi yes i asked for a receipt.. was told they would send it.. never thought tbh to create my receipt..

top up is high as rent is too high council would only pay so much and as it was the only landlord who had
1/property in the area i needed
2/ only one who wanted to accept deposit gaurentee

i only had a month to find somewhere as my prev rented property the landlord didnt pay the mortgage and the bank didnt know she was renting.

at the time i was desperate plus my partner had said he would help as we was going move in together but we are no longer together.

Even if you didn't pay the top up, you should have set the money aside so it would be ready when you needed to pay it.

Landlord can only evict if you are 2 months in arrears, that is 2 x total rent for month not 2 months of top ups.
