Listed twice by mistake

I have just received this message from a seller...

Dear buyer,
thank you for purchasing this item.
Unfortunately, it was listed twice by mistake and this resulted in two purchases for the same item.
We are trying to rectify this but may need to refund your money.
I sincerely apologise for this. I will let you know as soon as possible.

I was the first bidder and the second one tried to snipe in the last seconds by the looks of the sale.

What should I do? Any advice would be great.

If you were the first bidder then you should get the item and then the second bidder will need a refund if they can not get another one. This is the proper way of dealing with it.

I would suggest this to them in a nice way, and if they can not do this then you would appreciate a prompt refund.
No you're not a vegetarian if you eat any animal or fish, so do not insult genuine veggies by calling yourself one!

I read the email as the seller having one item yet two auctions on ebay for the same one item?

Yes that's how I read it. Look into their history and see when yours was bought and price paid versus the other one. That might give you a clue on whether they are genuine or not.

It does happen so be generous unless you are convinced they are it and if so hit the hard.

    Hi guys,

the auction was for a boys coat and messanger bag, one sale. The seller had listed it as a dutch auction by mistake, states 2 items.

    16-Nov-08 16:21:06 GMT - bidder 2 s.gif
    16-Nov-08 16:21:06 GMT - auction end

    s.gif 09-Nov-08 16:21:39 GMT - start

I have sent her an email saying nicely what cat had said, still waiting to hear back.
  • Dutch auctions are evil!
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
  • At the end of the day they ahve made a genuine mistake and refunded you in a polite manor. We know that Dutch auction rules state that you should get it, but it wasnt meant to be a dutch aution. If you complain etc, you most probably wont get the item and will just cause yourself and the seller more hassle.

Just put this down to human error and move on.

    Yep.

Can the seller refuse to sell and list again?
