hrm and hrc awarded after appeal for dla

hi i was turned down for dla but after going to appeal won and was awarded hrc and hrm on friday, have been told to claim income support at the moment i get incapacity benefit long term rate of 93.60 after spending all day on the phone still none the wiser of what to claim, i am single but with a 4yr old daughter get 50.40 ctc and 18.80 child benefit was getting some hb a ctb i feel like its all to daunting and really dont know what to ask for any help greatly recieved thanks in advance:confused:

    if you have a look on entitledto.co.uk, and input your details, it should give you the details of what you can claim - eg. Income support, council tax benefit, housing benefit etc. For income support, you need to have savings under £6000, but if that is the case, then as far as i know, you should be entitled to some income support. But definitely have a look at the website

  • yeah thanks i will have a look on there,
    its all so confusing but will say appeal hearing was not scarey at all i worried myself sick for a month before would say to anyone that is having doubts about going to appeal to just tell them what your worst days are like.
  • I Hope this helps - As you are already on Incapacity Benefit what you will be entitled to is what they class as an Income Support top up - basically this means you have to apply for income support although you are only technically elligible for premiums. If you haven't had any DLA before now, and you now get high rate care (It doesn't make any difference what rate mobility you get) you will be able to apply for the disability premium £25.85; the enhanced disability premium £12.60; and if you live alone and no-one claims carers allowance for you you can also claim severe disability premium £50.35 (yes all 3!!). You have to phone the DWP helpline and they go through a number of questions with you - they then send you the stuff to sign. When you are on the phone, ask them to also send you an IS10 (the form to claim the severe disability premium). When you get the forms through - staple the IS10 to the claim form for income support (they have a nasty habit of going missing!) The other 2 disablity premiums should automatically be added to your entitlement, but the SDP does have to be applied for seperately as there is the condition of 'living independantly' attached to it. It's worth photocopying your DLA award notice to the income support claim as well as it can sometimes take time for the departments to talk with each other. What will happen, they will then work out what your entitlement will be - i.e your personal allowance plus family and disability premiums. They will then deduct what you are already getting and the difference is then paid to you as income support. You often get one letter saying you aren't entitled to income support, followed by another confirming that you are entitled to SDP which can be very confusing, but don't panic too much, but always worth checking that they have processed all your forms!You also need to let tax credits know as you may get an additional allowance if you have to pay childcare as a result of your disability, and also if you get housing / council tax benefit you also need to let them know as it can slightly increase the amount you get, especially if they don't pay all of it at the moment. Also don't forget your free bus pass / blue badge and motobility. I hope I haven't confused you too much.
  • Also forgot to say that not only will your DLA be backdated to the date you claimed it, but your income support premiums / housing benefit etc will be as well. So knowing how long DLA claims (upto 3 months) then DLA appeals (an additional 6 months)take this could be quite a few months worth of back dated benefit hitting your bank account. (The money usually goes into your account before you get the letter telling you how much it will be!)

  • Does anyone know how long it takes for payments to be made following an appeal? my husband was sucessful at his appeal three weeks ago and was awarded hrm and mrc. he had a form at the weekend in the post asking for his bank details again and whether he had been in hospital at all since February. He's convinced DWP will appeal the tribunal hearing and Im sure he will stop feeling anxious when the payments are made?


    Also, the local council will not process his application for a blue badge until he sends them a copy of his award letter, which obviously he hasnt yet received.

    He phoned DLA today and they said it will be dealt with 'in due course'.

    Hope someone can help

    You should get the payment in 4 to 6 weeks. It is normal for them to send the letter about bank details and hospital stays. This to me indicates that they are in the process of sorting out the back payment. It is very rare for the DWP to appeal against a decision so that is unlikely.
  • You will not automatically get sent a new award notice for DLA after a successful tribunal. You can request one, especially if you want to access motobility. The slip of paper the tribunal gave you confirming the success of your appeal and the rates you have been awarded should be sufficient to satisfy the local council for a blue badge application.

    income support sent me a letter saying that i was not entitled to backdated premiums to when dla was awarded sent them a letter asking for reconsideration (they said they have not recieved it) should i send another letter or will they not change their descision
