In answer to Kem's question 'how you got on in the end' - we still haven't reached the end!!
We have a solicitor on the case, but are finding it very hard to firstly get hold of him, and secondly get any information from him
It has been suggested that we pay for the works ourselves and carry on trying to get the money reimbursed, which is looking likely at the moment, not that I'm at all happy doing this!
I'll be leaving ANOTHER message on the solicitors answer machine today, and in the meantime am currently looking for someone else to take over.

Wonder if you have had any sucess with your insurance claim? We have just found out that a house we bought in January 2008 has secondary flooding and our insurance company state that the previous owners insurnance is liable but we a re unable to contact them now as they live in Austrailia. How did you get on with your solicitor?0 -

It would appear that in fact you should claim on your current insurance -
" The ABI has become aware of a number of claims which have been notified to insurers after a customer has moved into a property and some time later discovered that the property has been damaged by earlier flooding. This is despite the customer getting a survey which did not pick up any evidence of flood damage.
In these cases the customer should submit their claim to their current insurer. Their insurer will then investigate the claim to establish whether the damage was caused by flooding. If these investigations conclude that the damage was caused by flooding they will deal with the claim. However, if the insurer concludes that the damage was not caused by flooding and was caused by something which is not covered by the insurance, then the insurer may decline the claim. In these circumstances, if the policyholder makes a complaint they will be directed to the insurer's complaints procedure.
It is up to individual insurers to decide whether they wish to seek recovery from other insurers, surveyors or other parties."

Hi all...now 2 years on from the floods i think we are starting to get some signs of secondary flooding.
We never got flooded but next door did..the thing is we changed insurers from 2007 when the policy expired.
We are now back with the same insurer at the time we had the floods,but this is a new policy..where would i stand as putting a claim in for secondary flooding even though it was 2 years ago now.
Any help would be much appreciated.0 -

As per previous comment, submit the claim to the current Insurer for consideration. If they argue, then refer them to the ABI advice.0
