Just Had Car Crash -any Advice Re Claim

    Bossyboots - if you are saying that you were the only person injured and that it was as a result of the OTHER driver - then HE needs to report the accident
    It doesn't matter who reports it, as long as it is reported and all parties stay at he scene or exchange all the correct details. If it is reportable and nobody reports it, all drivers are committing the "failing to stop and report" offence.

    OTOH, to take the law to it's ridiculous extreme, it is possible to have a fatality and not report the crash to the Police.

    From the circumstances you outline, I cannot see a problem with not reporting it as long as it has been dealt with to your satisfaction. Having said that, if your injury causes problems at a later date, it may well be of benefit to have a Police record of all the evidence in order to go at her insurance again.

    I would at least keep all correspondence and write a statement now while it is all fresh in your mind.

    I am currently pursuing a claim for my injuries/out of pocket expenses and am just waiting for a medical check up. My injuries and treatment to date have all been documented and I have all my receipts.

    There was no problem with exchanging details and in fact my family and the girl's family have known each other for some time as she only lives in the next street and my children went to school with her siblings. I am happy with the prompt settlement for my car and my PI claim is progressing through my solicitor so there seems no reason to report it unless I am legally obliged to. It is of no concern to me whether she reported it, I certainly would not expect her to.

    I too am currently pursuing a claim for my injuries/out of pocket expenses when I got rear-ended in June. My insurance got my car fixed and didn't charge me the £200 excess as it was obvious who was to blame. I felt neck pain after a couple of weeks so claimed off the other driver as I had legal cover - they sent me for a medical check up with an expensive private doctor. Now I've received a letter saying the other driver is disputing the circumstances of the accident! Looks like it will be a while before its sorted but surely truth will prevail!
    The moral: Get witnesses and take photos; if in doubt, call the police.

    Learn from the mistakes of others - you won't live long enough to make them all yourself.
