housing benefit,taken over home from father

my brother has taken out a 25 year morguage with my father after 15 years of my father paying my brother has carried on paying the mortguage iv put in a lump sum off the mortguage so my brother and i are now paying jointly,my father and us have drawn up a certificate of trust to say we now own the house as long as he lives in it,can i claim housing benefit as landlords,mainly to get much needed work done around the house,he needs a shower putting in,or will they want to know why my father has started paying rent after living in the house for 46 years and never claimed before,,,help

    there are similar threads about this running. Seems that the rules relate to not being able to claim HB for a property you have owned in the previous 5 years unless you can prove that you sold it to stop it being repossessed or similar. Have the deeds been changed. If they are still in your fathers name then he would still be classed as owning it and if they have been changed there will be an expectation that he received a payment for the sale. I don't think you can just give away your assets then claim benefits.

  • If your father has lived in the house 46 years, how come there's an outstanding mortgage?

    I don't think you are allowed to manipulate a situation in order to claim benefits.

    From my understanding you cannot claim Housing Benefit on a property you have owned/joint owned in the preceding 5 years. Plus of course if the house is signed over to you and your brother the Council and possibly DWP could want to know what has happened to your father's share of the equity. Be very careful, especially if he is claiming any means tested benefits.
