Cordless phone world

In June I bought BT freestyle 310 twin phone from Cordless phone world. They have never been right, one of them will barly charge and the other has a very short battery life, unlike BT phones I've had before.
I got in touch straight away and they replaced the batteries, this seemed to help at first but the problem is apparant again and has been for some time, one handset switches itself off and beeps all the time dispite being on charge all the time.
I bought the phones new and assumed I had a full 12 month warranty but having emailed them they are saying they are out of warranty, but there is nothing to say on their site about how long the warranties are.
They have just emailed to say that the warranty is 90 days and clearly stated on their advertisment, what advertisment? I can understand it being 90 days on a refurbished product, but not a brand new one.

Can someone who knows a little more about this have a look for me, I can't believe the warranty is only 90 days on a new product.
Thank you

It s a matter under the Sale of Goods Act (SGA). Specifically, s. 14 in that the goods are not of satisfactory quality (barring that they hav supplied two dodgy sets of batteries). Further, part 5A of the SGA requires that it is for the seller to prove that the goods "conform to the contract" - ie - are what you pay for. That means it is not for you to prove your point - but for the seller to prove that there is no problem0

"Refurbished
These are items returned to the manufacturer but after inspection and testing by our telecom engineers have been found with no fault. These items are then sold with a 90 day return to base warranty.""Love you Dave Brooker! x"

Do they make telephone calls using the public phone system?
YES - Conforms to contract0 -
Unfortunately the Consumer Vent Board has been overrun by trolls who have a grudge against all consumers, and deliberately post incorrect and misleading information on a daily basis (just take a quick glance at the posting history of the two above!).
Regrettably the MSE powers have allowed this problem to go unaddressed for many months. Therefore consider this forum well and truly "wrecked".
I'd suggest that you post your question on https://www.consumeractiongroup.co.uk (in the General Consumer Issues forum) where you're likely to get sound advice.0 -

As you know perfectly well [STRIKE]Jon Rhodes[/STRIKE] Dave, warranties are nothing and the SoGA is everything.Do they make telephone calls using the public phone system?
YES - Conforms to contract
Utter nonsense (as usual).0 -
Let me clarify one thing, they are NEW not REFURBISHED although they do sell refurbished phones too.
And yes they can sometimes make calls but also cut out abd beep constantly.
Thank you for the advice, especially taxiphil.
