Hi I started to share a flat with 2 others in March on a 6 month tenancywhich expired in October. Was told by landlord then I could continue to rent on a month to month basis however one flatmate moved out and since the new one moved in have had to sign a new lease covering the three of us for six more months.
I haven't signed the lease and was informed today that if I didn't and commit to a further six months I would have to leave immediately! I had been trying to get in touch with him last week but he was on holiday. Prior to that he had been trying to contact me by leaving notes on my door, none of which mentioned me having to move out, they just wanted to know my intentions. He also said he had been leaving me texts and voicemail messages but it was on someone else's number (if at all, he later relented and admitted the ansafone wasn't my voice despite earlier insisting it was).
Anyway he then said if I signed the lease and wanted to get someone else to take it over during the duration that would be fine and I would get my deposit back but naturally I'm suspicious as he didn't say this the first time. What should I do and what rights do I have? I don't particularly want to sign up to another six months as I'm not very happy here.

If he wants you to go, he needs to give you notice. As the fixed period has now passed the landlord would need to give you 2 months notice to end on a rent day.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Proper paperwork too. Written notice in a particular format. A Section 21.
He can go whistle basically. You're safe.
You've got from now until your next rent day AND a further two months notice even if he does the proper paperwork tonight.0 -
Unless he served a section 21 when you moved in......I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Which would now be invalidated by the creation of a periodic tenancy provided the OP has paid their rent for November...
There is no problem here.
Not according to other discussions we've had on here. A section 21 correctly served supposedly gives the tenant the right to leave at any time after the end of the fixed period. I'm sorry I think I have misunderstood. I thought your original post was saying that the LL would not have to issue a new S21 if they wished the OP to leave if they had issued one at the start. The actions of the LL would mean that the LL could no longer rely on a S21 issued at the start of the tenancy (offering extension, accepting rent and forming periodic tenancy etc).
However, in this post you discuss the Ts obligation to provide notice which would have been removed if S21 was served at the start. I think we have been posting at cross purposes!0
