Breach of PCI, do the CC companies care?

Booked a Christmas meal for me and a few work colleagues at a well known gastropub in London. They took my credit card details, including security code by phone (originally asked for them by fax!!), when I asked if they were running it through a till for a nominal amount to verify the card, they said no, they were writing the numbers on my fax, and then filing it in a cabinet. But apparently, not to worry as if we turn up they will shred the fax!

Complained that I thought this breached regulation on data storage, but they didn't give a monkeys and wouldn't book the table without it.

Have reported it to Amex to check their position before I complain to the company / famous chef that owns the chain.

Also realised that as they weren't using the number there and then, could have given any old rubbish and they wouldn't have known. If only I knew what they were doing with it when they asked....

Do the cc companies take this stuff seriously?
