Abbey CC Fraud

Hi there,

I am in the middle of a dispute with Abbey over some transactions on my credit card account that were not made by me. The account in question was opened 11 months ago for the purpose of a balance transfer. I never intended to use the card and just opened the account for the balance transfer on offer. If I am honest, I am not 100% sure that I ever even received the card as it was a long time ago and I was not needing to use it. I never activated the card, though apparently some cards are sent pre activated.

When my last statement arrived I noticed several large cash withdrawalls and transactions that were obviously not me. I have queried this with the fraud team and they inform me that as the card was used in conjunction with the PIN, they will not accept liability and I have no come back.

The only explanations are that either a) I never received the card or pin (though why would someone try and use the card 11 months later?) or b) the card and pin were takem from a folder I keep at home with all my financial information (stupidly also including PIN numbers...) or c) the bank themselves are involved

The case is now also being handled by the police and as far as I am aware, they are accessing CCTv of the person using the card. According to the police, the only chance I have of getting my money back is if the person is caught and I then take a civil action against them. But then I would be liable for the interest the amount accrues between now and when the case is conlcluded.

This all seems a bit unfair (though I accept I may have been foolish)and I wondered if anyone had any advice on what I can do to contest the banks decision.
