6 days to go and I am really upset

I am off work today, been feeling so ill, cant stop crying. Very scared about going bankrupt on the 19th and I had to tell my friend last night why I hadnt paid her and she now knows and I am worried she will go frantic mad at me and also tell other people at work. Cant face going in. Also know I need to ring ford who I have finance with as I need to ask what they will do about the car - wether they will take it off me. Sorted out new living acc, move into renting on the 25th Jan. The mortgage company already has a court order, i think its called, as we have missed 3 payments this year, so does this mean if we miss another one they will go to court to get the possession order, if so how long will this take? I am wondering if we pay decemeber and januarys payment and if its worth it seeing as we are leaving mid jan, what do you guys think? been endlessly looking through paperwork about ground maintenance payment for our property, and cant find anything about if your homes repossessed, need to know if we are liable for the payments until new people live here. I am planning to go to Barcalys after court to see if they will let me set up an account...I have a basic account with lloyds at mo, but i am sure this will be frozen. Hubby said last night that it would all be ok and there will be a light at the end of the tunnel, but i dont feel like that, i feel there is no light, even once BK i still have the stress of my friend making my life as miserable as poss, and i am so scared how i will feel when we leave our home for renting, i feel such a failure. Sorry for the depressing post, just always feel better when i post on here. xxx

Sorry to hear you are feeling so down today. If the lady is a friend she will understand and if she goes blabbing then she's not much of a friend. Will you be able to start repaying her again soon? If anyone says anything to you then just say that yes you have got yourself in to a mess but have pulled your head out of the sand. You have taken professional advice and you are following that advice, then walk away.

You can start the process of opening an account now if it will help you.

Ithink that the mortgage company will have to go back to court to get a repossesion order so that will take a little time and if you have a moving date then I am sure the judge will be sympathetic. Some one will be along later to advise on this.

Thanks Tigerfeet - we used to be close, but she fell out with me last year which makes this even harder. It all depends on how much money i am allowed after BK, as the OR will not include her repayment in my expenditure. After BK and after if i get one the BK payments, i will pay her double till i pay it off, but just feel so so so so bad that she is left covering it, i just cant believe how stupid i have been, i cant cope with the thought I am making someone else miserable because of my mistakes. Aw, I just feel awful about it. I might go in to the bank and ask for the forms so i can just hand them in on the day. Doesnt feel real all this sometimes does it. x

Do you think she can take me to court to get it back, can you take a bankrupt to court? x

No she can't take you to court as it will fall into your BR. She has to get in line with all your other creditors to be paid if you get an IPA. But as you have said when you get your finances sorted you will try and juggle them to pay her back on the quiet.

When you are BR get on to the other boards and see where you can make cut backs and savings and make extra money to get it paid.

Will it not be classed as a guarantor as the loan is in her name? I am worried she wont be intitled to anything, and that i will have to pay her out of whats left, the payments 300 a month, thats my housekeeping for the month...

Wonder if it might be worth you going round to her house with a bottle of wine. Explaining the reasons why you can not pay her at the moment ect,. Try explaining that if anybody gets wind of this, the loan will have to be included in your bc and you wont be able to pay her;) .Ask her very very nicely not to mention it at work,, and see what happens. If despite all that she still won't play ball,have you thought of changing your job once bc? Then you can pay her and not worry about gossips with nothing better to do.Dx

Thanks Dalip (again!) I have been thinking about moving jobs, but really dont want to because i love it, but if it gets bad i will.

If the loan is in her name then she is responsible for it unless you have some form of written contract. £300 is a lot of money to find every month, are you going to be able to do it? I can see why she might not be happy. Have you put a SOA up on here at all?
