Just reaslied I'm on the winners list too! I guess that's a good thing but if no one's heard anything maybe not! Now I'm not sure if I should feel happy or let down! ha ha

As it's being chased by other I think I might levae it for now, if there haven't been any updates in the next couple of days I'll fired off an e-mail or something to them though.

Unfortunatly - I think this in the terms and conditions will just about cover there asses in this one:

9. INM will not be liable for any circumstances beyond its reasonable control that prevent a prize being taken up by a winner. INM excludes liability to the extent permitted by law for any cost, claims or losses howsoever caused that arise by reason of any person's entry into a competition or the award to them of a prize.

I've noticed on other website terms that say something along the lines of "the prize may be exchanged for one of equal or greater value in the event that...blah blah blah" but I couldn't see anything like that in there.

anyone can write unfair terms down but whether they are enforceable that is another matter

I do tend to sue people can't help myself lol

I think I will write the terms that I require £100 everytime my name is published on their site in a winners list that isn't actually factual haha

Unavailability of the prize

Sometimes at the end of a promotion it is no longer possible to award the prize as originally described, for example because of unforeseen supply problems. If there is a risk of this, promoters should make sure that the rules state that the promoter reserves the right to substitute another prize of similar or greater value if circumstances make this unavoidable. In such a situation, the alternative prize should be as close to the original prize as possible, bearing in mind that it is a Code requirement to always use one’s best endeavours to avoid unnecessary consumer disappointment.

I just had a reply very similar to pugsleys origioanl one, with one important modifier!


Unfortunately the company who was to provide the prize has gone bust, we are awaiting a reply from our contact to find out how or if we can reimburse you. I shall keep you updated with any information.

We are very sorry for any inconvenience, unfortunately this was out of our control as the company who was supposed to provide the prize never showed any signs of something like this happening.

So that seems at least partly hopeful! I guess for now we just wait and see! I'd normally expect to hear within about 2 weeks, but as it's the christmas season I won't expect anything for more like 3 to 4 I reckon.

Hi there,

I spoke to the company in between Christmas and New Year (finally after ringing 4 or 5 times) they have told me much the same as you guys. But they did say they would try and offer a substitute and would get in contact with me by the end of January.
I will let you guys know if i hear anything. Please do the same
