In a Panic

I have recently gone bankrupt and had my OR interview.I was previously on a DMP but didn't include my maintenance in this. The OR wants the paperwork from my DMP. I have declared my maintenance on my SOA. What is likely to happen? I am in a panic and am even having visions of being sent to prison for fraud!!!

    You simply say it was an oversight on your part if asked.

    I wonder why the OR has asked for your DMP details?

  • Its £200 a month. It was included but I couldn't afford to live so took it off. Whats the worst that can happen?

    How long did this go on 123?

    Can you prove you could not live without this? if so your OR may realise this is why the DMP has failed, do you work?

  • I took the maintenance off in February this year. I do work but my sons Dad got funny with me because I couldn't afford to feed and clothe my son properly when he was paying me money Due to the DMP's unrealistic amounts. I wasn't in the right state of mind to argue

    Then I think that is what you tell the OR.

    The thing is you would still be in a DMP if you could have afforded it, but you could not even with the maintenance taken out.

    Tell me what did the DMP company say when you removed it ??

  • Nothing, he said that he wasn't gonna pay me anything anymore so thats what I told them. After I nearly had a breakdown and threatened to go to a solicitor he started paying again. I was happy to stay in a DMP but my debt was just increasing because of the interest and fees that they continued to charge me and i couldn't take the threatening letters and was suicidal.

    If the OR does get funny about this what is the worst they can do

    I think if you explain this exactly as you have here, the OR should accept what you say. Have you been under the doctor? ie for depression due to all of this? if so maybe your doctor if needed can write you a letter for the OR.

    Can you prove you OH stopped the payments? as you may be asked that.

    The worst they could do is a BRO/BRU but I dont honestly see them doing that for this.

    He may ask what you have spent the extra money on each month, but that is easy, since February all prices have rocketed, food, gas, electric, your childs clothes so you can explain it that way.

    Have you got all your bank statements etc? in case he needs them or has he already had those?

    Please dont worry, they cannot send you to jail, and a BRO/BRU is just an extension of the time you cannot get credit for or be a director of a company.

    Are you on benefits of any sort? Do you work? has the OR questioned your SOA income and expenditure? or anything else come to that? or is the DMP arrangement the only thing you have been asked for so far?

  • Not receiving any benefits. I have got a thing to sign for my NT tile the end of the tax year. Have had interview and gone through what each loan was used for and why I have gone BR. Hasn't asked for statements or anything just the DMP Correspondence. Certainly haven't been friviolus with the maintenance it has been spent on food, bills and other living expenses

    I do not think you have too much to worry about.

    Is your surplus under £99 per month 123? or are you going to have an IPA?

    Maybe he just wants to see what you were paying the DMP to see if it fits with what you have on your SOA for the BR, is there any large changes other than the maintenance which is not on there?

  • No and with realistic figures for basic living expenditure and my maintenance included there is only £12 more surplus than what I was paying on my DMP
